On monitoring the application of European Union law in 2023 and 2024

B d. whereas a considerable number of petitions submitted to Parliament focus on the fundamental rights of EU citizens, in particular the rights of persons with disabilities; whereas in 2023 the Commission decided to send a reasoned opinion to several EU Member States for failing to transpose the EU rules on the accessibility of products and services for persons with disabilities (Directive (EU) 2019/8821a) into their national law;

Stresses that petitions received by Parliament constitute a vital instrument for identifying shortcomings in the implementation of EU law, including systemic or structural breaches thereof in Member States; urges the Commission, therefore, to ensure that information and findings emerging from petitions are systematically taken into account and integrated into its enforcement and monitoring processes;

Acknowledges that the Commission’s 2023 report on monitoring the application of EU law makes several references to petitions that have led to follow-up actions; urges the Commission, however, to demonstrate more clearly the impact of petitions on its enforcement actions across all policy areas, and to provide detailed statistical data on the number of petitions followed up by the Commission, including those that have led to further investigation through EU Pilot processes or infringement procedures;

Agrees with the Commission that equality and non-discrimination are foundational principles of the EU, particularly in the areas of employment and inclusion; supports the Commission’s decision to launch infringement procedures against several Member States (Denmark, Estonia and Italy), and to advance proceedings against others (Bulgaria, Cyprus, Ireland, the Netherlands and Poland), in order to ensure the full transposition of Directive (EU) 2019/882 on accessibility into national law, which has been raised in numerous petitions addressed to Parliament; welcomes the establishment of the ‘AccesibleEU’ initiative as a support centre to assist Member States in implementing EU accessibility legislation;

7 c. Notes that Parliament has received several petitions raising concerns about child sexual abuse, particularly online; expresses concerns that, in 2023, the Commission initiated infringement procedures against 16 Member States for incorrect transposition of Directive 2011/93/EU on combating child sexual abuse1a, of which only two cases have been closed; encourages the Commission to continue its efforts and to use all available procedural and legal means to ensure the full and effective implementation of EU law in this area;

Calls on the Commission to guarantee a commitment to full transparency and public access to documents and information concerning ongoing and closed EU pilot and infringement procedures, in order to ensure a full understanding of the actions taken by EU institutions and Member State authorities to address violations of EU law; underlines that such disclosure is essential for the proper examination and follow-up of petitions related to these matters;

Notes with concern the limitations of the new Europa implementation platform, launched in April 2025; points out that, despite its potential, the platform primarily consists of data tables and fails to provide essential information on ongoing or concluded procedures, offers no analysis of the data presented, and makes it nearly impossible to draw comparisons and conclusions in certain cases, making it insufficiently useful for legislators, legal practitioners, and citizens seeking insight into how EU law is upheld in practice;12. Notes with concern the limitations of the new Europa implementation platform, launched in April 2025; points out that, despite its potential, the platform primarily consists of data tables and fails to provide essential information on ongoing or concluded procedures, offers no analysis of the data presented, and makes it nearly impossible to draw comparisons and conclusions in certain cases, making it insufficiently useful for legislators, legal practitioners, and citizens seeking insight into how EU law is upheld in practice; recalls, moreover, that the Commission’s stocktaking report on its working methods for monitoring the application of EU law recommended the establishment of an interactive portal intended to provide real-time information on the Commission’s enforcement activities, as well as to serve as an access point for complaints, offering details on investigations into alleged breaches raised, inter alia, through petitions, and regrets that this has not been fully achieved;

Acknowledges that the Commission has revamped the infringement decisions web page, better linking it with Parliament’s Petitions Web Portal; calls, however, on the Commission to work closely with Parliament to strengthen the interconnection between Parliament’s Petitions Web Portal and the Commission’s infringement database, with a view to ensuring greater consistency, transparency and efficiency in handling and following up on petitions; underlines that enhanced interoperability between these platforms would improve access to information for citizens and institutions alike, and reinforce Parliament’s political oversight and scrutiny role in monitoring the application of EU law;

Urges the Commission to ensure that petitions are systematically integrated into its enforcement processes, including, in line with the recommendations of the European Court of Auditors’ Special Report 28/2024 on enforcing EU law, through full interconnection between its petitions database and the Themis case management system; calls, further, on the Commission to reinforce this tool in order to facilitate correspondence with complainants and to gather data from all relevant channels, in particular petitions, with a view to tracking complaints of a similar nature and feeding this data into both enforcement and policymaking work, thereby enhancing consistency, accountability, and public confidence in the application of EU law by Member States;

Reaffirms the important role of petitions in identifying various forms of infringements of EU law; recalls, as acknowledged in the Commission’s 2023 report on monitoring the application of EU law, that petitions on labour mobility, the recognition of professional qualifications and migration have led to the opening of proceedings or referrals to the Court of Justice of the EU in some Member States; encourages the Commission, in this respect, to conduct thorough investigations into breaches of EU law raised by petitions;
