| 23a. Considers that judicial and parliamentary scrutiny of a government and its agents is of vital importance for the rule of law and democracy, especially for so-called special services whose activities are usually kept secret; stresses that state security and intelligence services, the need for which cannot be put into doubt, must nonetheless not become a ‘state within the state’, exempted from accountability for their actions, since such lack of accountability leads to a dangerous culture of impunity, which undermines the very foundations of democratic institutions; condemns in this regard that the pre-constitutional Official Secrets Act is still in force in Spain; |

Paragraph 26 a (new)
| Motion for a resolution | Amendment |
| 26a. Expresses its deep concern about claims made about the co-chair of the Green Group in the European Parliament in his podcast of 11 December 2024, where he claims that in exchange for a vote in favour of the College of Commissioners, he was given ‘substantive pledges’ and promised ‘places in the cabinets, so we also get some political positions’1a; underlines that, if his claims are accurate, this practice would not appear to be in line with Article 245 TFEU, which clearly states that Commissioners undertake to respect their independence and avoid influence; recalls that, in their oath, Commissioners solemnly declare to be completely independent in carrying out their responsibilities and neither to seek nor to take instructions from any government or from any other institution, body, office or entity in the performance of their tasks; believes that this raises serious concerns regarding the rule of law; | |
