Justification

There should be a mandatory involvement of municipalities in the implementation of EPR-systems for textiles. This is missing in the proposal and needs to be added, especially to ensure a uniform, regional organisation of the separate collection of textiles by the municipalities with the involvement of local social enterprises. Social enterprises should not be obliged to hand over used textiles to PROs, before or after sorting as such social enterprises make these used textiles available either for sale as second hand textiles or by donation to those in need. It is as important that the waste textiles not eligible for reuse but destined for recycling or destruction, are delivered to the relevant PRO and its contracted waste treatment installations.

Justification

As the EC proposed, social enterprises should not be obliged to hand over used textiles to PROs that could be either sold as second hand textiles or donated. However, it is as important that the waste textiles not eligible for reuse but destined for recycling or destruction are delivered to the relevant PRO and its waste treatment installations.

Justification

Separately collected textile waste is not a by-product from a production process and therefore Art. 5 does not apply. In order to ensure that sufficient organisation and investment is put in place to ensure the separate collection and treatment of textile waste takes place, it is important to ensure that all textiles collected in bins, whether door to door, bring system or in a civic amenity site are subject to the waste status and permit obligations.

Justification

In order to ensure that the separate collection and treatment of textile waste takes effectively place, it is important to ensure that all textiles collected in bins, whether door to door, bring system or in a civic amenity site are subject to the waste status and permit obligations. This will ensure that illegal shipments of waste textiles leaving the EU under the label of ‘used textiles’ are limited through the notification requirements.

Important to maintain consistency with the Waste Shipments Regulation. Need to ensure that textile waste is not being exported under the banner of used textiles, as it unfortunately happens in some cases presently, which then proceed to be landfilled. The likelihood of used textile products being discarded and becoming waste, and being disposed to landfills increases when allowed to be exported and if they are mixed. It is important that there is no legal loophole regarding not-waste status of used textile products, where otherwise it would have been possible to be permitted to be exported under the Waste Shipments Regulation. Crucial to maintain adherence to the waste hierarchy in Article 4.In the Waste Shipments Regulation, textiles are referred to in recitals 11b and 16a, as well as Article 75 paragraph 3a, which regards adding textiles entries on mixtures of waste such as used footwear, clothing and other textile products, including the mixtures of these, to Annex IIIB (i.e. additional green listed waste awaiting inclusion in the relevant annexes to the Basel Convention of the OECD decision as referred to in Article 58 paragraph 1 point (b).

1. At the request of Member States, the Commission shall provide assistance, including information campaigns, and sufficient technical know-how to help successfully foster projects under Horizon Europe, InvestEU, Cohesion Fund, European Regional Development Fund, EU4Health, LIFE programme, and, where appropriate, other programmes, to help improve the waste management systems in Member States. Projects aimed at improving waste management systems may address all types of waste. Such projects may include, but are not limited to:
(a) automated machines which collect plastic and other physical solid waste from rivers, lakes, and seas on the coastlines;
(b) technology which would facilitate the achievement of the objective to eliminate illegal landfills in the Union, as laid down in Article 12a, such as deploying drones and using satellite imagery for better scientific monitoring;
(c) other projects, as deemed necessary by Member States.
2. The Commission and Member States shall endeavour to achieve at least one such project in each Member State.
3. Following a request by a Member State, and with a view to ensuring the health and well-being of the citizens concerned, the Commission shall provide, without undue delay, financial and technical support to Member States, w to assist them in implementing their waste management plans.
4. Where appropriate, the Commission and Member States shall consider where funds can be allocated in the Multiannual Financial Framework in order to improve waste management systems in Member States.
5. Member States and the Commission shall undertake efforts to make financing available for projects from the Annex III to the Delegated Act1a in the Taxonomy of 27 June 2023 for investments pertaining to waste management and remediation activities; collection, transport and treatment of hazardous waste; sewerage; remediation of legally non-conforming landfills and abandoned or illegal waste dumps; and remediation of contaminated sites and areas.
6. Member States and the Commission shall undertake efforts to explore the application of industry 4.0 and artificial intelligence in the field of waste management and waste generation prevention.

Evaluation
By 31 December 2026, the Commission shall carry out an evaluation of this Directive and of its contribution to protect the environment and human health by preventing or reducing the generation of waste, protect the environment and human health by preventing or reducing the generation of waste, and of its contribution to the Union’s long-term competitiveness. The Commission shall present a report on the main findings to the European Parliament, the Council, the European Economic and Social Committee, and the Committee of the Regions. Member States shall provide the Commission with the information necessary for the preparation of that report.

Justification

The term ‘households’ omits used textiles and textile waste generated in hotels, hospitals, restaurants, offices, schools and so on. It is important to amend the proposal from ‘household textiles’ to simply ‘textiles’ because where the textile item has been used and where the waste is generated should not be of any relevance to producer responsibility. This is in line with AM to Article 22a paragraph 1.
