A a. whereas a reasonable and feasible implementation of a green and digital transition has the potential to effectuate a profound and sustainable transformation of Europe’s economies, regions, and labour markets; whereas ensuring an effective and affordable transition to a developed and digitalised economy, alongside the reduction of energy supply dependencies on all major foreign economies, is imperative for Europe’s long-term sustainability and economic growth; whereas the ultimate success of the transition is contingent upon guaranteeing that such transition is conducted in a just and inclusive manner, taking into account the interests of workers, businesses, and regions affected, and is supported by financially viable innovative technologies and generally affordable energy; whereas it should be further emphasized that the current challenges faced by the European labour market are partly attributable to the shortage of skilled labor and the influx of unskilled irregular migrants, as substantiated by the European Commission’s disclosure that more than 7 million unemployed migrants currently reside within the European Union 1a;

B. whereas managing the shift to a carbon neutral economy should not only support transitions to new jobs in emerging sectors but also maintain and adapt existing jobs and sectors to climate-neutral and clean industries and technologies in partnership with people living in impacted territories; whereas it is important that workers and jobseekers feel supported in managing transitions through early and continuous social dialogue, co-design, and transparent decision-making, in order to foster understanding, trust, and a durable democratic mandate for the aims of the 2050 strategy; whereas as shown by Eurofound research,1a broad involvement of civil society, social partners and public authorities in the transition process is critical to securing and fairly distributing the returns from economic activity and resources, as well as navigating conflicts;

Enforcement measures

In order to ensure the effective and implementation and enforcement of the directive, the proposal should include at least the following measures:

a) conditional access to public resources: Member States shall ensure that in the performance of public contracts, economic operators comply with the obligations of the directive and that beneficiaries of European and state aid comply with the obligations of this directive, of applicable social and labour law of Union and national law and with collective agreements;

b) penalties: the Directive should lay out a minimum level of effective, proportionate and dissuasive penalties to be laid down by the Members States in cases of infringement of the rights and obligations falling within the scope of this directive;

c) non-regression and more favorable provisions: the directive shall not constitute valid grounds for reducing the general level of protection already provided for workers within Member States; the Directive shall not affect the prerogative of Member States to apply or introduce laws, regulations or administrative provisions that are more favourable to workers and/or affected communities, or to encourage or permit the application of collective agreements which are more favourable to workers;

d) ensuring fundamental rights and autonomy of social partners: nothing in this directive shall be interpreted or applied in a manner that restricts, infringes upon, or undermines the fundamental rights recognised in Member States, including the right to collective bargaining, the right to strike, or the right to take collective action; this Directive respects the autonomy of social partners and does not affect their ability to negotiate, conclude, or enforce collective agreements, or to engage in other activities consistent with national industrial relations systems, with the aim of building on top of and enhancing the obligations and rights set out by this Directive.
