European Parliament resolution on the EU position on the proposed plan and EU engagement towards a just and lasting peace for Ukraine

The European Parliament,

– having regard to its numerous previous resolutions on Russia’s war of aggression against Ukraine,

– having regard to the Charter of the United Nations,

– having regard to the Rome Statute of the International Criminal Court (ICC),

– having regard to the Geneva Conventions,

– having regard to Rule 136(2) of its Rules of Procedure,

A. whereas the Russian Federation has been waging an unprovoked, unjustified and illegal war of aggression against Ukraine since 24 February 2022, in continuation of previous aggressions since 2014, and continues to persistently violate the principles of the UN Charter through its acts of aggression against the sovereignty, independence and territorial integrity of Ukraine;

B. whereas the UN General Assembly, in its resolution of 2 March 2022, immediately classified the Russian war against Ukraine as an act of aggression in violation of Article 2(4) of the UN Charter, and, in its resolution of 14 November 2022, recognised the need to hold the Russian Federation accountable for its war of aggression and legally and financially responsible for its internationally wrongful acts, including by making reparations for the injury and damage caused;

C. whereas Russia’s crime of aggression against Ukraine and its countless war crimes constitute a brutal attack against the peaceful lives of citizens in a sovereign European country and against the principles of cooperation and security in Europe, as agreed under the 1975 Helsinki Final Act and the 1990 Charter of Paris for a New Europe;

D. whereas Russia’s war of aggression against Ukraine threatens the peace, security, democracy and prosperity of the entire European continent in an unprecedented manner and therefore requires equally unprecedented actions in response;

1. Urges the EU, its Member States and its international partners to support, in the most determined way, Ukraine’s desire for a just and lasting peace that must be based on full respect for Ukraine’s independence, sovereignty, territorial integrity and right to choose its alliances, the principles of international law, accountability for war crimes, crimes against humanity and the crime of aggression, and Russian payments for the massive damage caused in Ukraine and that must effectively exclude any further aggression by Russia;

2. Notes the efforts by the US administration under President Donald Trump towards ending Russia’s war of aggression, but considers that US policy ambivalence towards Ukraine is detrimental to the objective of achieving sustainable peace; presses, therefore, for the EU and its Member States to continue working with the United States and like-minded partners to ensure that negotiations for a just and lasting peace for Ukraine take place in respect of the above principles, in good faith and with the objective of definitively ending Russia’s aggressions against Ukraine as a sovereign European nation;

3. Firmly condemns any attempts by the United States at blackmailing Ukraine’s leadership into surrender and any proposals that would effectively undermine the sovereignty and security of Ukraine and therefore endanger the long-term security of the entire European continent and, instead, embolden the Russian aggressor to continue its attacks against Ukraine and its European partners; emphasises that certain proposals recently presented as US proposals would amount to a pact at the expense of Ukraine and the EU and would jeopardise the decades-long transatlantic partnership on common security and prosperity;

4. Recognises that peace negotiations will require compromises and concessions from both sides and notes the absence of concessions by the aggressor, Russia, in initial proposals; underlines, however, that Russia’s war of aggression is unprovoked, unjustified and illegal and constitutes a grave violation of the UN Charter, and that the EU, its Member States and all countries that adhere to the UN Charter must reject any proposals that would further undermine the principles of international law and the rules-based international order;

5. Considers that, taking into account the history of Russia’s blatant violations of previous legally binding agreements and fundamental principles of international law, any agreement on sustainable peace will have to be preceded by a ceasefire and be backed by effective measures to monitor the implementation of commitments and deter delayed fulfilment of obligations, and be underpinned by robust US and EU security guarantees to Ukraine that contribute to preventing renewed aggressions;

6. Reiterates its urgent call for the EU, its Member States and their international partners and transatlantic allies to substantially enhance their military support as well as their political and diplomatic efforts to defend Ukraine and pressure Russia into participating genuinely in negotiations and definitively ending its war of aggression in order to re-establish peace for Ukraine and security for the entire European continent;

7. Underscores that there is a strategic imperative for Europe to switch to proactive engagement with the aim of achieving peace for Ukraine, consisting of exerting decisive pressure on Russia, while providing sufficient support to Ukraine and united actions with allies and partners;

8. Expresses its hope that genuine negotiations, backed by the full political, military and economic weight of the transatlantic community and its international partners in and beyond the G7 and G20, can establish a comprehensive, just and lasting peace for Ukraine and open the path to fair and inclusive economic and social recovery, and to Ukraine’s future as a member of the EU;

9. Instructs its President to forward this resolution to the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy, the Council, the Commission, the governments and parliaments of the Member States, the Council of Europe, the Organization for Security and Co-operation in Europe and to the President, Government and Parliament of Ukraine.
