B c. whereas, at the last session of the United Nations General Assembly, United States President Donald Trump openly attacked the United Nations system and questioned its legitimacy and effectiveness; whereas United Nations Security Council Resolution 2803 endorsed the establishment of a Board of Peace as a temporary and strictly transitional administration for the redevelopment of Gaza; whereas, subsequently, President Trump publicly announced the intention to vest the Board of Peace with a permanent mandate and an expanded geographical and functional scope, extending well beyond Gaza, without renewed authorization by the United Nations or its Member States; whereas publicly available documents and draft charters circulated by the United States Government concerning the establishment of the Board of Peace envisage the creation of a new international organisation operating outside the UN system, whose membership would be determined exclusively by invitation, at the discretion of a self-appointed lifetime chairperson, thereby departing from established principles of multilateralism, equality of states, and democratic governance; whereas these draft instruments further contemplate the imposition of mandatory financial contributions, fees, or “participation costs” on affected populations and participating entities, without representative consent, parliamentary oversight, or transparent budgetary controls, raising serious concerns as to legality, accountability, and potential exploitation; whereas the proposed governance structure of the Board of Peace appears to allow for selective participation and exclusion based on political alignment or strategic interests, thereby institutionalising a principle of discrimination incompatible with international human rights law, the UN Charter, and the principle of sovereign equality of states; whereas the absence of judicial review mechanisms, independent oversight, and clearly defined limits to authority risks granting the Board of Peace unchecked executive, administrative, and financial powers, undermining the rule of law and setting a precedent for parallel governance structures imposed without international consensus; whereas the composition and the organization of the BoP presents great uncertainties regarding the actual participation and agency of Palestinians in the reconstruction process, and their future, which runs counter to the objectives set in UNSC resolution 2803;
