DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a directive of the European Parliament and of the Council amending Directive 2013/11/EU on alternative dispute resolution for consumer disputes and amending Directives (EU) 2015/2302, (EU) 2019/2161 and (EU) 2020/1828 following the discontinuation of the European Online Dispute Resolution Platform

– having regard to the Council position at first reading (11778/1/2025 – C100309/2025),

– having regard to the opinion of the European Economic and Social Committee of 14 February 2024,

– having regard to its position at first reading on the Commission proposal to Parliament and the Council (COM(2023)0649),

– having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

– having regard to the provisional agreement approved by the committee responsible under Rule 75(4) of its Rules of Procedure,

– having regard to Rule 68 of its Rules of Procedure,

– having regard to the recommendation for second reading of the Committee on the Internal Market and Consumer Protection (A10-0249/2025),

1. Approves the Council position at first reading;

2. Notes that the act is adopted in accordance with the Council position;

3. Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4. Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5. Instructs its President to forward its position to the Council, the Commission and the national parliaments.

SHORT JUSTIFICATION

On 17 October 2023, the Commission submitted the proposal for a Directive amending Directive 2013/11/EU on alternative dispute resolution for consumer disputes, as well as Directives (EU) 2015/2302, (EU) 2019/2161 and (EU) 2020/1828 to the Council and the European Parliament. On 13 March 2024, the European Parliament adopted its first reading position.

The interinstitutional negotiations started on 20 February 2025 with a view to reaching an early second reading agreement. They were successfully concluded on 26 June 2025. The provisionally agreed text was confirmed by COREPER on 16 July 2025 and endorsed by the IMCO Committee on 25 September 2025.

Since the Council’s first reading position adopted on 17 November 2025 reflects the agreement reached between the Parliament and the Council in early second reading interinstitutional negotiations, including also the changes resulting from the legal-linguistic revision, the Rapporteur recommends that it is endorsed by the European Parliament without amendments, so that the Directive can be adopted swiftly and enter into force as soon as possible.

ANNEX: DECLARATION OF INPUT

The rapporteur declares under her exclusive responsibility that she did not include in her report input from interest representatives falling within the scope of the Interinstitutional Agreement on a mandatory transparency register, or from representatives of public authorities of third countries, including their diplomatic missions and embassies, to be listed in this Annex pursuant to Article 8 of Annex I to the Rules of Procedure.
