Safeguards governing Union compulsory licences
The Union compulsory licence may only be considered as a measure of last resort, after the demonstrated exhaustion of all voluntary solutions, and must remain strictly exceptional so as to preserve incentives for innovation and the economic value of intellectual property rights.

3 a. The scope of the compulsory licence must remain proportionate and may under no circumstances exceed the quantities strictly necessary for managing the crisis, in order to avoid any lasting distortion of the internal market and to protect the competitiveness of European companies.
