The Agreement in the Annex is hereby adopted, subject to the signing, on behalf of the Union, of the said Agreement. The adoption of the Agreement by the Union and its Member States shall be without prejudice to the national competences in the field of energy supply and investment protection. 	(2a) The Commission shall submit to the European Parliament and to the Council, no later than six months after the entry into force of this Agreement and thereafter annually, a report on the effects and implementation of the Agreement, in particular with regard to pending proceedings and financial risks for the Member States.

Annex – Article 6 – point 2 b (new)

	(2b) This Agreement shall apply only for the period until the withdrawal of the European Union and the Member States from the Energy Charter Treaty takes full effect. Upon expiry of that period, all provisions of this Agreement shall cease to have effect.
