Meaningful brake testing is performed if brake efficiency is below the service, secondary or parking values prescribed in 1.2.2 or 1.3.2 or 1.4.2 but all the following conditions are met: — the braking system is in good condition with no obvious defects, — wheels of all axles lock because adhesion between the tyre and brake tester surface was exhausted during the brake test; if wheels on some axles do not lock, it must be safely concluded that the braking efficiency values prescribed in 1.2.2 or 1.3.2 or 1.4.2 would be achieved when the vehicle is loaded, — brake actuation level by the inspector must always be proportional to the current load of the axle. Information on system values may be retrieved using electronic vehicle interface. Road tests should be carried out under dry conditions on a flat, straight road. In cases where vehicles of R or T category are tested on the road, meaningful brake testing is performed if all the above conditions are met. Justification
In practice, if this wording is maintained, there is a risk that vehicles with defective or unsatisfactory brakes will be type-approved. In view of the risk involved, we propose deleting this one entry from the table.

Justification
The test with 100 Ohms is senseless. In ECE R100 100milliOhms is defined and this is the correct value measuring ground continuity or earth conductor. 100 Ohms is not a valid reference value. Inspection of this point should be mandatory, given that it is part of the R100 regulation.

Justification
The need for an effective and reliable suspension test is nowadays even more evident with electronic-assisted braking systems and ADAS (Advanced driver-assistance systems) equipped vehicles already on the road, self-driving vehicles soon to come, and heavier EVs.
The suspension system is a vital element for the vehicle's braking ability and direction control. Nowadays, there are suspension testers on the market suitable for testing the suspension systems of vehicles in categories M1 and N1 during statutory periodical technical inspections, whose goal is to ensure road safety. Suspension tests for M1 and N1 category vehicles should be part of the roadworthiness test, as initially proposed by the European Commission.

As vehicle approval legislation—such as the GSR, Regulation (EU) 2019/2144, and Regulation (EU) 2018/858—does not require vehicles to be equipped with cornering lights, this feature cannot be mandated in periodic technical inspections. Accordingly, a malfunctioning cornering light cannot be deemed a defect. Inspection capacity should be directed toward legally required, safety-relevant systems.

Justification
With regard to points (f) and (h), the minor defects should be deleted as there is no point in including them: if a defect does not affect the safety of the vehicle, it should not be checked during a roadworthiness test. Another point is that it should be difficult for the inspector to differentiate between major and dangerous defects. Therefore, only major defects should be retained.

Justification
Création d'un nouveau point provisoire pour le contrôle visuel de la fonction ADAS : actuellement, les défauts liés à l'aide à la conduite qui peuvent être détectés par inspection visuelle ne peuvent pas être attribués à un ADAS spécifique en raison de limitations techniques. Nous proposons donc de modifier l'annexe 1 - pendant un nombre d'années limité et jusqu'à ce que l'inspection électronique soit mise en place et fonctionnelle - et de créer un nouveau point 10.1a. Ce nouveau point permettrait de regrouper les défauts liés à l'ADAS pouvant être détectés par inspection visuelle, plutôt que de les répertorier systématiquement dans chaque fonction. Ce point permettrait de faciliter le contrôle et l'inspection des véhicules.

Justification
The proper performance verification (system check, component plausibility and functional test) is critical for those safety systems that have been inserted as mandatory under (GSR 2019 2144 and implementing acts), play an active role in road safety (e.g. Automatic emergency braking system, Lane keep assist), and in which a reduction in performance or a calibration loss could create road dangers because of drivers over-reliance on them.
At this moment, it is crucial that the ADAS systems most critical to safety - specifically the Automatic Emergency Braking system (AEB, point 10.09 in the Commission’s proposal) and the Lane Keep Assist (LKA, point 10.47 in the Commission’s proposal) - must undergo not only visual inspections but also functional tests. These should be able to detect potential faults before they lead to accidents.
It is a priority to verify the operation of these two driver assistance systems, as they are the ones that most affect driving behaviour. Should they fail or not function properly, they would pose a greater risk to the safety of the vehicle, its passengers, and other road users.

Justification
The proper performance verification (system check, component plausibility and functional test) is critical for those safety systems that have been inserted as mandatory under (GSR 2019 2144 and implementing acts), play an active role in road safety (e.g. Automatic emergency braking system, Lane keep assist), and in which a reduction in performance or a calibration loss could create road dangers because of drivers over-reliance on them.
At this moment, it is crucial that the ADAS systems most critical to safety - specifically the Automatic Emergency Braking system (AEB, point 10.09 in the Commission’s proposal) and the Lane Keep Assist (LKA, point 10.47 in the Commission’s proposal) - must undergo not only visual inspections but also functional tests. These should be capable of detecting any potential faults before they lead to accidents.
It is a priority to verify the operation of these two driver assistance systems, as they are the ones that most affect driving behaviour. Should they fail or not function properly, they would pose a greater risk to the safety of the vehicle, its passengers, and other road users.

As vehicle approval legislation—such as the GSR, Regulation (EU) 2019/2144, and Regulation (EU) 2018/858—does not require vehicles to be equipped with adaptive headlights, this feature cannot be mandated in periodic technical inspections. Accordingly, malfunctioning adaptive headlights cannot be deemed a defect. Inspection capacity should be directed toward legally required, safety-relevant systems.
