European Parliament legislative resolution of 25 November 2025 on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council on the safety of toys and repealing Directive 2009/48/EC (09663/1/2025 – C10-0251/2025 – 2023/0290(COD))
(Ordinary legislative procedure: second reading)
– having regard to the Council position at first reading (09663/1/2025 – C100251/2025),
– having regard to the opinion of the European Economic and Social Committee of 13 December 2023,
– having regard to its position at first reading on the Commission proposal to Parliament and the Council (COM(2023)0462),
– having regard to Article 294(7) of the Treaty on the Functioning of the European Union,
– having regard to the provisional agreement approved by the committee responsible under Rule 75(4) of its Rules of Procedure,
– having regard to Rule 68 of its Rules of Procedure,
– having regard to the recommendation for second reading of the Committee on the Internal Market and Consumer Protection (A10-0227/2025),
1. Approves the Council position at first reading;
2. Takes note of the declaration by the Commission annexed to this resolution, which will be published in the C series of the Official Journal of the European Union;
3. Notes that the act is adopted in accordance with the Council position;
4. Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;
5. Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;
6. Instructs its President to forward its position to the Council, the Commission and the national parliaments.
ANNEX TO THE LEGISLATIVE RESOLUTION
DECLARATION FROM THE COMMISSION ON THE OCCASION OF THE ADOPTION OF REGULATION (EU) 2025/2509
The Commission regularly and systematically evaluates the occurrence of hazardous chemicals in toys, taking into account available scientific evidence, with a view to adapting the limit values or the conditions for the presence of specific chemical substances or mixtures in toys in accordance with Article 46 of Regulation (EU) 2025/2509 on the safety of toys. For that purpose, the Commission will request an opinion from the European Chemicals Agency on the safety of nitrosamines and nitrosatable substances in toys, in view of the overall exposure, within 12 months of the entry into force of this Regulation. For the same purpose, the Commission will request an opinion from the European Chemicals Agency on the safety of lead, cadmium, mercury and chromium vi in toys, in view of the overall exposure, within 24 months of the entry into force of this Regulation.
