Ha. whereas on 26 January 2024, in the case of South Africa v Israel under the Genocide Convention, the ICJ ordered that Israel must take urgent provisional measures to prevent acts that could bring about the physical destruction of Palestinians in Gaza, ensure the unhindered provision of basic services and humanitarian assistance, prevent the destruction of evidence, and report to the ICJ on compliance with this order; whereas on 28 March 2024, the ICJ reaffirmed these measures and further held that famine in Gaza had not only become a risk but was actively occurring, obliging Israel to ensure unhindered humanitarian access and keep border crossings such as Rafah open, among other measures, and to ensure that its military refrain from actions disrupting life-saving assistance;
