DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the draft Council decision on the conclusion on behalf of the European Union of the Agreement between the European Union and Bosnia and Herzegovina on the cooperation between the European Union Agency for Criminal Justice Cooperation (Eurojust) and the authorities of Bosnia and Herzegovina competent for judicial cooperation in criminal matters

– having regard to the draft Council decision (13622/2024),

– having regard to draft agreement between the European Union and Bosnia and Herzegovina on the cooperation between the European Union Agency for Criminal Justice Cooperation (Eurojust) and the authorities of Bosnia and Herzegovina competent for judicial cooperation in criminal matters (13241/2024),

– having regard to the request for consent submitted by the Council in accordance with Article 47, Article 52(1), Article 56 (2) and Article 218, of the Treaty on the Functioning of the European Union (C100165/2024),

– having regard to Rule 107(1) and (4) and Rule 117(7) of its Rules of Procedure,

– having regard to the recommendation of the Committee on Civil Liberties, Justice and Home Affairs (A100000/2025),

1. Gives its consent to the conclusion of the agreement;

2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States and the authorities of Bosnia and Herzegovina.

EXPLANATORY STATEMENT

Eurojust works with national authorities to combat a wide range of serious and complex cross-border crimes such as terrorism, cybercrime, human trafficking, drug trafficking, migrant smuggling. In a fast changing modern world, with emerging, but also persisting threats, safety and security of our citizens is crucial. We need to use all the tools at our disposal to make sure our society is protected from dangers posed by those that break our laws. Cooperation in criminal matters and coordinated judicial response to growing threats, allows the Member States to keep one step ahead of criminals and organised crime.

The objective of this agreement is to enhance judicial cooperation between Eurojust and the competent authorities of Bosnia and Herzegovina in order to more efficiently combat serious crime, which very often is transnational and extends to countries outside of the European Union. This agreement will allow for the transfer of personal data between Eurojust and the competent authorities of Bosnia and Herzegovina, in order to support and strengthen the action by the competent authorities in investigating and prosecuting serious crime, in particular organised crime and terrorism.

At the same time, it will ensure appropriate safeguards with respect to privacy and protection of personal data.

The conclusion of this agreement will provide added value in ensuring safer and more secure Europe for our citizens.
