Justification

This new Status Agreement with Bosnia and Herzegovina represents yet another step in the EU’s broader strategy of externalising border control and migration management, effectively outsourcing responsibility for protecting refugees and asylum seekers to third countries with weaker safeguards. Despite references to compliance with EU standards, the agreement lacks sufficient guarantees to prevent human rights violations and to ensure independent oversight of Frontex operations. Moreover, the European Data Protection Supervisor (EDPS) has not been formally consulted and has stated that there is no adequate legal basis for the transfer of personal data to Bosnia and Herzegovina, raising serious concerns about legality and the potential misuse of migrants’ data. In this context, the agreement risks making EU institutions complicit, directly or indirectly, in fundamental rights violations, including unlawful returns and breaches of data protection standards, and should therefore be rejected.
