European producers of ductile cast-iron pipes face the same structural pressures identified in the proposal, including persistent global overcapacity, state-supported expansion of production in third countries, and resulting price and volume pressure on the Union market. These distortions undermine the competitiveness of a capital-intensive sector essential for water and infrastructure networks. Including CN 73 03 in the Annexes ensures coherent coverage of sectors exposed to comparable excess-capacity risks.

Justification

Ductile iron (73 030), whose mechanical properties are comparable to those of steel, and which is produced using the same industrial processes in blast furnaces, is essential for hydraulic infrastructure and the competitiveness of the EU. In this context, Regulation (2025/0726) must protect European ductile iron production from global overcapacity to support the EU's threatened steel industry, in the same way as it does for steel.

Justification

The proposed amendment aims to include ductile iron in Annex I of the draft Regulation, in order to provide the sector with trade defense instruments similar to those already in place for steel. This integration responds to the need, repeatedly highlighted by industry operators and institutions, to protect a strategic supply chain for the industrial and infrastructural resilience of the Union, which is currently highly exposed to the distortive effects of global overcapacity and international dumping. The inclusion of the relevant customs codes would help restore competitiveness to the sector, support the continuity of production at European plants, and strengthen the EU’s ability to ensure secure and autonomous supplies in a segment essential for the functioning of water infrastructure.

The safeguard measures currently in application have played a substantial role in maintaining steel production in the European Union. However, their scope has been established in 2018, at a time when some products did not qualify for trade protection under stringent rules of the Regulation (EU) 2015/478. This distinction does not make sense today, after almost eight years during which some of those products have been facing the very negative trade-related effects of overcapacities – even more, due to their relatively low level of protection compared to most of other steel products. The economic situation of European manufacturers of those steel products calls for an immediate action, without waiting for the potential scope enlargement pursuant to Article 9(1). Those steel products would represent four new categories, from 29 to

32. Modifications in the total volume of TRQs allocated through the Regulation (18.3 Mt proposed by the Commission) and of their allocation among all product categories would be mandatory after relevant calculations by the Commission (pursuant to the methodology used to design its proposal).

The current steel safeguard measure only includes the product category “non alloy wire”. Such exclusion has allowed extra-EU countries, in primis Turkey and China, to easily circumvent the EU measure.

In 2024, EU consumption of ductile cast-iron pipes amounted to 470 500 tonnes. Applying the methodology set out in the proposal, and using the 2013 import market share of 13%, the tariff quota for ductile cast-iron pipes should therefore be set at 61 165 tonnes.
