Justification

We are tabling an amendment to reject in the event that European farmers' interests are not safeguarded in the face of high fertiliser prices, if the AGRI committee's opinion is not duly taken into consideration and if there is no requirement for an assessment of the impact of these new duties on the agricultural sector and on European fertiliser producers.

Moreover, the imports of the concerned agricultural goods could create a similar and additional economic dependency on the Russian Federation, which should in the present circumstances be prevented and reduced in order to protect the Union’s markets and safeguard the Union’s food security.

(2) The imports of the fertilisers covered by this Regulation (‘the concerned fertilisers’) currently reflect a situation of economic dependency on the Russian Federation. Moreover, the imports of the concerned agricultural goods could create a similar and additional economic dependency on the Russian Federation, which should in the present circumstances be prevented and reduced in order to protect the Union’s markets and safeguard the Union’s food security. Yet, although that dependency should stop in order to strenghten the strategic autonomy of the Union, its gradual reduction itself should not be too steep in order to not be counterproductive and jeopardize the Union's food security.

(4) The continued importation of the agricultural goods and fertilisers covered by this Regulation from the Russian Federation under current conditions could make the Union vulnerable to coercive actions by the Russian Federation. In particular, a potential increase in the importation of the concerned goods from the Russian Federation could disrupt the Union’s market and negatively impact the Union’s producers. It is therefore necessary to take appropriate tariff measures in order to address the Union’s current and potential economic dependency on imports of those goods from the Russian Federation. This should be done by ending the current situation where they enter the Union market on terms that are as favourable as those applied to goods from other origins that receive most-favoured-nation treatment.	(4) The continued importation of agricultural goods and fertilisers covered by this Regulation from the Russian Federation, under the current conditions, risks increasing the Union’s vulnerability to coercive actions by the Russian Federation; moreover, the persistently high level of mineral fertiliser use sustains import demand from Russia, thereby generating a significant revenue stream that contributes to financing its war of aggression against Ukraine. In particular, a potential increase in the importation of the concerned goods from the Russian Federation could disrupt the Union’s market and negatively impact the Union’s producers. It is therefore necessary to take appropriate tariff measures in order to address the Union’s current and potential economic dependency on imports of those goods from the Russian Federation. This should be done by ending the current situation where they enter the Union market on terms that are as favourable as those applied to goods from other origins that receive most-favoured-nation treatment.

It is therefore necessary to ensure predictable and sufficient access to fertilisers, at affordable price levels for Union farmers, which should in turn contribute to the stabilisation of agricultural markets. During a transitional period, the proposed measure would stimulate stepping up the Union production and allow for reinforcing alternative sources of supply from other international partners, minimising the risk that fertilisers prices for Union farmers increase substantially. To this end, the Commission should monitor closely the evolution of fertiliser prices on the Union market. Should fertiliser prices substantially increase, the Commission should assess the situation and take all appropriate actions to remedy such surge.	(10) At the same time, fertilisers play a significant role for the food security as well as for the financial stability of the farmers in the Union. It is therefore necessary to ensure predictable and sufficient access to fertilisers, at affordable price levels for Union farmers, which should in turn contribute to the stabilisation of agricultural markets. During a transitional period, the proposed measure would stimulate stepping up the Union production and allow for reinforcing alternative sources of supply from other international partners, minimising the risk that fertilisers prices for Union farmers increase substantially. To this end, the Commission should conduct an ex-ante impact assessment and monitor closely the evolution of fertiliser prices on the Union market. In the absence of viable and affordable alternatives, this risks undermining the competitiveness of the Union agricultural sector. To enable farmers to access cost-effective, Union-produced fertilisers, reduce dependency on third-country imports, and contribute to reduction of CO2 emissions, the Commission should establish a legal and financial framework that makes manure, including ReNure, a viable alternative. This framework should provide regulatory flexibility beyond the limits currently established by the Nitrates Directive (91/676/EEC).

Given the significant volumes currently imported and the limited short-term flexibility to shift suppliers without incurring additional costs, such measures should not result in the reduction of fertilised agricultural areas and sub-optimal application rates. The Commission should ensure that these measures do not lead to lower yields, diminished profitability, and potential negative consequences for food security and farmers’ livelihoods. Therefore, a mandatory monthly monitoring of the prices of products listed in Annex II should be established to ensure timely responses and safeguard the viability of the Union farming sector.

Justification

The Commission's proposed tariff measure clearly contradicts its own regulation guidelines. An additional delay would provide the necessary time for the European Commission to conduct an extensive impact assessment, evaluating all potential consequences of the tariffs while not jeopardizing the EU food security.

Justification

L’Union européenne ne dispose pas de sources domestiques de phosphates minéraux et d’engrais phosphatés, ce qui la rend fortement dépendante des importations en provenance de pays africains et de la Russie. En outre, le Règlement (UE) 2019/1009, qui fixe une limite maximale de cadmium à 60 mg/kg de P₂O₅, aggrave cette dépendance en favorisant la roche d’origine russe, naturellement pauvre en cadmium. La proposition de la Commission européenne risque de réduire encore davantage la diversification des fournisseurs de phosphates, augmentant ainsi la dépendance à un nombre restreint de sources situées dans des pays africains. Par ailleurs, ces sources ne sont pas nécessairement conformes à la limite européenne en matière de cadmium. C’est pourquoi les codes NC 310520 (N, P, K), NC 310530 (DAP), NC 310540 (MAP, MAP et DAP en mélange), NC 310551 (N, P), NC 310559 (N, P) et NC 310590 doivent être exclus du champ d’application de l’article 1, paragraphe 2, point b) du règlement proposé.

The proposed quota would be too much of a drop considering the current level of dependency of the EU to these products. A quota of 4,2 millions with one additional year to adjust would still be below the average for the past 8 years while giving much needed time to European farmers and consumers.

Any modifications to tariff quotas or goods included in scope shall be based on the findings of these evaluations to ensure market stability and minimal disruption to the agricultural supply chain.

Justification

The European Commission should focus on impact assessments for phosphate, potash, and nitrogen fertilizers, as these are vital to EU agricultural production. Analyzing whether Russian exports in these sectors are benefiting from unfair state subsidies or pricing practices will help prevent market distortions. Additionally, the broader catch-all category (3105 90) should also undergo scrutiny, particularly for fertilizers that could be misclassified or combined in ways that unfairly impact EU farmers and fertilizer producers

It is unacceptable that the proposal has not been accompanied by an impact assessment. That runs counter to the principles of good governance and rigorous rule-making. The main sector affected will be agriculture; and it is essential that, prior to any move forward, both the legislative authority and the stakeholders in the sector should have a full picture of the consequences of the proposal. An annual-review clause is therefore needed.
