(8 a) The extension introduced by this Regulation is exceptional and applies only to the specific circumstances described herein. It does not constitute a precedent for any further extensions of data protection periods under the review programme.

Justification

While the extension extension of the review programme until 2030 can justify an extension of data protection for the biocidal active substances under review since 7 June 2018, this amendment ensures that this extension should be exceptional and not set a precedent for any further extensions of data protection. This should also underline the need for Member States to finalise the review programmes as agreed under EU Regulation.
