Justification
Soil monitoring is the responsibility of the Member States and regard also has to be had for ownership and management rights. Monitoring approaches exist at Member-State level that take these requirements fully into account. Furthermore, parallel structures with different methods, indicators and evaluation frameworks should be avoided. For example, for 30 years there have been harmonised monitoring systems for forests (ICP Forests).

2 a. By the first evaluation of this Directive at the latest, the Commission shall adopt a delegated act amending part A of Annex I to draw up a list of key contaminants and thresholds for individual substances as well as for total concentration of groups of pollutants.
This list shall include, inter alia, heavy metals, plant protection products, contaminants linked to sewage sludge and compost, microplastics, veterinary products, pharmaceuticals, antimicrobials, substances identified as ecotoxic, persistent, bioaccumulative, mobile and toxic, and contaminants of emerging concern.
The list and thresholds shall be developed taking into account existing and to be set thresholds by any relevant Union legislation e.g. for water quality and air quality.
When establishing the list referred to in subparagraph 1, the Commission shall take into account existing frameworks at Union level, including inter alia data collected on the use of plant protection products and fertilisers under Regulation (EU) 2022/2379, and data from the LUCAS Soil Observatory.

To ensure an accurate representation of soil health, it is therefore crucial that a temporary non-compliance with one criterion, which can be explained by recent documented changes on the sampled area, does not categorize that soil as unhealthy.

The provisions on sustainable land management in Article 10 of and Annex III to the proposal are not needed. There are already numerous rules and measures with the same objective. The conditionality requirements of the current CAP constitute comprehensive criteria for sustainable land management. De facto secondary legislation by virtue of the proposal's additional requirements would lead to areas of primary competence such as the CAP and the objective of sovereign food production being undermined.
