Justification

Soil monitoring is the responsibility of the Member States and regard also has to be had for ownership and management rights. Monitoring approaches exist at Member-State level that take these requirements fully into account. Furthermore, parallel structures with different methods, indicators and evaluation frameworks should be avoided. For example, for 30 years there have been harmonised monitoring systems for forests (ICP Forests).

This list shall include, inter alia, heavy metals, plant protection products, contaminants linked to sewage sludge and compost, microplastics, veterinary products, pharmaceuticals, antimicrobials, substances identified as ecotoxic, persistent, bioaccumulative, mobile and toxic, and contaminants of emerging concern.

The list and thresholds shall be developed taking into account existing and to be set thresholds by any relevant Union legislation e.g. for water quality and air quality.

When establishing the list referred to in subparagraph 1, the Commission shall take into account existing frameworks at Union level, including inter alia data collected on the use of plant protection products and fertilisers under Regulation (EU) 2022/2379, and data from the LUCAS Soil Observatory.

Evaluating soil health requires a careful and nuanced approach that cannot be achieved through an ‘one-out, all-out' principle. This is particularly evident since certain observed and documented changes affecting soil may lead to its temporary inability to meet all the criteria for healthy soils. To ensure an accurate representation of soil health, it is therefore crucial that a temporary non-compliance with one criterion, which can be explained by recent documented changes on the sampled area, does not categorize that soil as unhealthy.

Member States should provide service for small-scale managers that would like to get the land under its management monitored according to the monitoring design in Annex I and II of this Directive. The support would benefit both - Member State that would fill its soil monitoring with data aligned with this Directive, as well as to land manager that would receive free information on the state of the soil and possible assistance with dentification of measures that would help to improve its state.
