Amendment

3. Information on the assumptions on end-of-life treatment technologies in place, relevant technological progress in end-of-life treatment technologies and capacity investment in such technologies, as of submitting the application for type-approval, that the manufacturer used in order to calculate the reusability, recyclability and recoverability in accordance with Article 4 of the vehicle type.

deleted

Or. en

Justification

Since end-of-life vehicle handling and recycling companies are in competition with each other in a free end-of-life vehicle market, the disclosure of highly sensitive data to vehicle manufacturers regarding used and future technologies for end-of-life vehicle treatment and recycling and regarding the associated information on investments must be rejected.

Alexandr Vondra, Piotr Müller

Proposal for a regulation

Annex IV – Part A – point 5 – point b

Text proposed by the Commission

Amendment

(b) measures contributing to the development of recycling technologies for materials used in vehicles, for which such technologies are not widely available at commercial scale at the moment of submission of application for type-approval;

(b) measures contributing to the development of recycling technologies in cooperation with waste management operators and/or research institutes for materials and components used in vehicles, for which such technologies are not available at laboratory scale at the moment of submission of application for type-approval;

Or. en

Justification

At type approval, it is too early to define recycling measures for technologies not yet commercially available, as vehicles will be recycled only after 15+ years. For example, traction battery recycling began developing after EVs entered the market, but industrial scale is only feasible once sufficient vehicles reach end-of-life. UN R133 requires processes to be based on proven technology, at least tested on a laboratory scale.

Text proposed by the Commission

Amendment

(c) the monitoring on how parts, components and materials contained in vehicles belonging to the vehicle type are reused, recycled and recovered in practice;

deleted

Or. en

Justification

ELVs are processed by waste operators over 15 years after type approval, making real-time monitoring unfeasible. There is no global system to track all parts and materials, and waste streams mix after shredding, preventing traceability.

Or. en

Justification

Measures are already in place to encourage OEMs to promote the reuse of parts and components, particularly through the availability of second-hand spare parts for repairing older vehicles at lower costs. Insurance companies can further support this initiative by offering reduced premiums to customers who opt for repairs using certified used parts.

3. In case of significant changes in the design and production of the vehicle type, the updated circularity strategy shall have a particular focus on the following:

deleted

(a) changes in the use of parts and components in new vehicles which are easy to dismantle for reuse or for high quality recycling;

(b) changes in the use of materials in new vehicles which are easy to recycle;

(c) the adoption of design features to address the challenges posed by the use of materials and techniques which hamper easy removal or make recycling very challenging, for example adhesives, composite plastics or fibre-reinforced materials;

(d) changes in the use of recycled materials in new vehicles, remanufactured or refurbished parts and components in vehicles and of compatibility of parts and components from other types of vehicles; and

(e) changes in the use of substances referred to in Article 5 in new vehicles.

Or. en

Justification

The purpose of these detailed requirements, the intended recipients of the information, and its intended use remain unclear—for example, the term “high quality recycling” is not defined. The associated bureaucratic effort is expected to be extremely high, placing a significant burden on both industry and regulatory authorities. Again, this added complexity does not appear to offer any tangible environmental benefits.

Justification

Authorised treatment facilities should have access to essential information, particularly regarding component removal, as proposed by the Commission. Furthermore, waste operators, repair and maintenance operators already have regulated access to critical EV battery information under the EU Batteries Regulation (EU) 2023/1542, including state of health data, electrochemical performance, labelling, second-life operations, waste management, and the battery passport, making the reference to replacement in Annex V, point 2 unnecessary.

Dismantling gearboxes is less economical for dismantlers since shredders pay by weight. Therefore, if engines remain on the list, an exemption would be necessary, as the material can still be effectively separated after shredding using appropriate technology.

Amendment

7. Windshields, rear and side windows made of glass;

deleted

Or. en

Justification

The ecological benefits of dismantling vehicle glass at end-of-life are unproven. The process is labor-intensive, carries a high risk of injury, and demands exceptionally clean methods, as recyclers accept only 3 ppm (g/t) of contamination. Additionally, transport-related environmental costs are significant due to the limited number of glass recyclers in Europe, requiring long-distance shipments.

7. Windshields, rear, roof and side windows made of glass;

Or. en

Justification

Glass roof tops or parts of the roof are also fit for dismantling and recycling and should be added to the list. Without dismantling, end-of-life automotive glass is not usable for recycling. The shredding process contaminates the glass too much and renders it unusable for valuable recycling processes. Once shredded, it can only be severely down cycled. This is a waste of valuable resources and energy. Moreover, because adding glass cullet to recycling processes, lowers the amount of energy needed for glass production. Additionally, there are promising pilot projects for the recycling of the PVB fraction present in laminated glass of windshields.

Justification

Plastic containers, especially fuel tanks, are often heavily contaminated with fuel or other fluids, making recycling complex and resource-intensive. The environmental benefits of fuel tank recycling remain unproven, and no viable recycling industry exists. Mandatory dismantling is therefore unjustified unless spare parts are needed. Instead, authorised treatment facilities should determine whether dismantling is practical and worthwhile on a case-by-case basis.

Justification

The heat exchanger is located beneath the dashboard, positioned between the engine and passenger compartments, directly against the bulkhead. Removing it requires a complete dismantling of the dashboard. After shredding, its metal is separated for recycling. However, due to material fatigue and corrosion, its reuse potential is minimal.

Amendment

17. Any other mono-material metal components, heavier than 10 kg;

17. Any other mono-material non-ferrous metal components, except the engine and gearbox, heavier than 10 kg;

Or. en

Justification

Within existing reuse and remanufacturing operations, dismantlers extract parts for which there exists a market. The proposed deletions relate to parts and components for which the reuse market is very limited or simply does not exist. Mandatory removal of parts shall only apply if required by compelling safety reasons or when the subsequent shredding and post-shredding processes cannot extract and separate materials as efficiently as manual dismantling processes or semi-automated disassembly processes. As a guiding principle, the best available technology should be used for each recycling process. For engines and gearboxes, mandatory dismantling should be avoided unless there is a clear market demand for reclaimed materials. Instead, reuse or refurbishment should be prioritized.
