Justification
At type approval, it is too early to define recycling measures for technologies not yet commercially available, as vehicles will be recycled only after 15+ years. For example, traction battery recycling began developing after EVs entered the market, but industrial scale is only feasible once sufficient vehicles reach end-of-life. UN R133 requires processes to be based on proven technology, at least tested on a laboratory scale.

Glass roof tops or parts of the roof are also fit for dismantling and recycling and should be added to the list. Without dismantling, end-of-life automotive glass is not usable for recycling. The shredding process contaminates the glass too much and renders it unusable for valuable recycling processes. Once shredded, it can only be severely down cycled. This is a waste of valuable resources and energy. Moreover, because adding glass cullet to recycling processes, lowers the amount of energy needed for glass production. Additionally, there are promising pilot projects for the recycling of the PVB fraction present in laminated glass of windshields.

Within existing reuse and remanufacturing operations, dismantlers extract parts for which there exists a market. The proposed deletions relate to parts and components for which the reuse market is very limited or simply does not exist. Mandatory removal of parts shall only apply if required by compelling safety reasons or when the subsequent shredding and post-shredding processes cannot extract and separate materials as efficiently as manual dismantling processes or semi-automated disassembly processes. As a guiding principle, the best available technology should be used for each recycling process. For engines and gearboxes, mandatory dismantling should be avoided unless there is a clear market demand for reclaimed materials. Instead, reuse or refurbishment should be prioritized.

-1. Criteria for allowing shredding of end-of-life vehicles, their parts, components and materials together with other waste:
(a) Waste Electrical and Electronic Equipment has been treated selectively in accordance with Annex VII of Directive 2012/19/EU prior to shredding together with end-of-life vehicles;
(b) all batteries are removed from all types of waste as specified in Regulation (EU) 2023/1542, prior to shredding together with end-of life vehicles;
(c) plastic packaging is removed from Packaging Waste and metal Packaging Waste as specified in the [PPWR] is not yet sorted into specific alloy families prior to shredding together with end-of-life vehicles;
(d) the joint treatment of different waste fractions does not result in a deterioration of the quality of the waste streams resulting from treatment compared to the separate treatment of the waste fractions;
(e) the individual contribution of the mixed waste streams to the output fractions shall be able to be determined for the respective reporting requirements on treatment performance of end-of-life vehicles and other requirements for other waste streams such as Regulation (EU) 2023/1542, the [PPWR], Directive 2012/19/EU and Directive 2008/58/EC.

-1a. Quality requirements for the output fractions:
(a) The copper content of the main steel fraction shall not exceed 0.1% on a weight basis;
(b) Aluminium shall be sorted as a minimum into a cast alloys fraction as defined in the standard EN 1706:2020 and wrought alloy fraction, as defined in the standard EN 573-3:2019;
(c) The shredder heavy fraction derived after air separation and separation of iron, shall be further treated with the aim to separate ferrous, non-ferrous metals, plastics and other organic materials for recycling or recovery. The residue of these processes shall contain less than 1% of metal content by weight and, in accordance with Council Decision 2003/33/EC, less than 5% of total organic content by weight;
(d) The shredder light fraction shall be further treated with the aim to separate ferrous, non-ferrous metals, plastics and other organic materials for recycling or recovery.
