Recalls that, under Article 41 of the Schengen Borders Code and the declaration by the Kingdom of Spain on the cities of Ceuta and Melilla in the Final Act to the Agreement on the Accession of the Kingdom of Spain to the Convention implementing the Schengen Agreement of 14 June 19851a, specific rules apply in respect of Ceuta and Melilla, meaning that those arriving irregularly in Ceuta cannot travel freely onwards to the Spanish mainland or to other EU Member States or Schengen associated countries; --------------------------------- 1a The Schengen acquis – Agreement on the Accession of the Kingdom of Spain to the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders signed at Schengen on 19 June 1990, to which the Italian Republic acceded by the Agreement signed at Paris on 27 November 1990 (OJ L 239, 22.9.2000, p. 69, ELI: http://data.europa.eu/eli/agree_internation/2000/922(3)/oj).

Regrets Italy’s decision to introduce internal border controls with Spain as of 1 August 2026 in response to the events in Ceuta, and the subsequent extension of these controls until 16 September 2026; expresses serious doubts as to the necessity and proportionality of these measures, given the restrictions on onward travel from Ceuta to mainland Spain and other Schengen area states; calls on Italy to review these measures with a view to lifting them;

Recognises that a large number of unaccompanied children are still in Ceuta; stresses that the Spanish authorities must ensure the protection and appropriate care of unaccompanied minors; calls on the Spanish authorities to carry out individual assessments of their circumstances and needs without delay, with the minors’ best interests as a primary consideration, in accordance with EU law and the UN Convention on the Rights of the Child;

12b. Strongly rejects any collective, automatic or indiscriminate return of unaccompanied children or other vulnerable persons; stresses that any decision concerning the return or family reunification of unaccompanied minors must be made individually, after hearing from the child and assessing their family environment, and safety and protection needs, with full respect for the principle of non-refoulement and all applicable safeguards; underlines that family reunification is a child-protection measure and must not be used as an instrument of migration or border management;
