Recalls that, under Regulation (EU) 2024/13591a, instrumentalisation is by definition an act of a third country or hostile non-state actor directed against the Union or a Member State, and that the persons concerned are described therein as being subject to instrumentalisation; stresses that any response must therefore be directed at the instrumentalising actor and must fully respect the rights of the persons concerned, as guaranteed by international law, EU law and by the Charter of Fundamental Rights of the European Union; 1a Regulation (EU) 2024/1359 of the European Parliament and of the Council of 14 May 2024 addressing situations of crisis and force majeure in the field of migration and asylum and amending Regulation (EU) 2021/1147 (OJ L, 2024/1359, 22.5.2024, ELI: http://data.europa.eu/eli/reg/2024/1359/oj).
