B. whereas Commission Delegated Regulation (EU) 2019/807 established the methodology for determining high ILUC-risk feedstocks, explicitly requiring, in Article 3 thereof, that the assessment be based on data ‘since 2008’, and setting a threshold of 10 % expansion into high-carbon stock land above which a feedstock is classified as high ILUC-risk; whereas, applying that methodology and that baseline, the Commission’s 2019 report found soybean’s share of expansion into high-carbon stock land to be 8 %, which is below the qualifying threshold, meaning soybean was not classified as high ILUC-risk; whereas soy cultivated in the European Union therefore does not generate negative landuse change impacts and is produced in compliance with stringent Union environmental, climate and biodiversity standards, contributing to diversified rotations, soil fertility and improved resilience of farming systems;

Ga. whereas the unilateral shift of the observation period from 2008 to 2014 illustrates a broader pattern in which the Commission uses its delegated powers under Article 290 TFEU to introduce substantive policy changes with significant economic impact across the agri-food and biofuel value chains, rather than limiting itself to the technical, non-essential adjustments for which such delegation is intended; whereas, more generally, recourse to delegated acts should be discouraged and, in any case, strictly defined in the basic act, as the procedure does not provide the same level of democratic scrutiny as the ordinary legislative procedure, thereby leaving matters of significant economic and political importance solely in the hands of the Commission;

Ma. whereas first generation biofuels plays and will continue to play an important role in the transport sector, and this contribution should be duly recognised rather than being constrained by generic limitations introduced as an indirect way to address ILUC concerns; whereas the proposed Delegated Regulation risks contradicting the strategic objectives of developing an European biofuel value chains, as well as the protection of consumers from unnecessary increases in food and energy prices, particularly in highly exposed Member States;

1a. Considers that the methodology used by the Commission relies excessively on theoretical and globally aggregated models that do not adequately reflect the actual environmental performance of soy production in different production systems and regions, and that it does not sufficiently account for the specific characteristics of European soy cultivation and for the structural protein dependence of Member States; warns that the current proposal would generate severe economic consequences for the European agrifood sector, in particular for livestock, feed and biofuel supply chains, by increasing uncertainty over soy availability, raising feed and production costs, as well as the cost of sustainable fuels;

Stresses that soy cultivated within the European Union should, by definition, be considered a low ILUCrisk feedstock, in light of the absence of deforestation impacts; emphasises, once again, that Union policies must avoid creating unjustified additional competitive disadvantages for the Union operators and carefully distinguish between feedstocks and uses so as not to undermine protein autonomy and the stability of the agrifood sector in Member States;

Emphasises that, pursuant to Article 290 TFEU, delegated acts may only supplement or amend certain non-essential elements of a legislative act; considers that amendments to feedstock classification criteria entailing an estimated economic impact exceeding EUR 1.4 billion across the value chain are liable to affect essential policy choices and therefore raise serious questions as to whether they may appropriately be regarded as relating solely to non-essential elements; stresses that any such amendments should be accompanied by a comprehensive impact assessment, especially of the economic consequences; accordingly, calls for limiting the conferral of delegated powers on the Commission, particularly where such delegation is defined in overly broad and general terms, as this entails the risk of transferring to the Commission decisions with significant economic and political impact that should instead remain within the remit of the co-legislators;
