Calls for the establishment of a European Day in Remembrance of the Victims of Accidents at Work and for the Protection and Dignity of Workers, to be marked each year on 8 August, in memory of the tragedy at the Bois du Cazier mine in Marcinelle, which, owing to its intrinsically European nature – in that it involved workers from several countries that are now Member States of the EU – represents a common symbol of the struggles for decent work and the need for a common approach to the protection of health and safety at work; | 1. Calls for the establishment of a European Day in Remembrance of the Victims of Accidents at Work and for the Protection and Dignity of Workers, to be marked each year on 28 April to coincide with the ILO World Day for Safety and Health at Work, in memory of historic tragedies such as the tragedy at the Bois du Cazier mine in Marcinelle, which, owing to its intrinsically European nature – in that it involved workers from several countries that are now Member States of the EU – represents a common symbol of the struggles for decent work and the need for a common approach to the protection of health and safety at work; |

Calls on the Commission and the Member States to strengthen the enforcement of occupational safety and health legislation, including by ensuring adequate resources for labour inspectorates, improving cross-border cooperation and ensuring effective compliance, in particular in cases where gross negligence has led to serious injury or death; considers that in order for occupational safety and health rules to be credible and effective, they must be sufficiently dissuasive and proportionate; | 17. Calls on the Commission and the Member States to strengthen the enforcement of occupational safety and health legislation, including by ensuring adequate resources for labour inspectorates, improving cross-border cooperation and ensuring effective compliance, in particular in cases where gross negligence has led to serious injury or death; considers that in order for occupational safety and health rules to be credible and effective, they must be sufficiently dissuasive and proportionate; calls for the strengthening of enforcement mechanisms, and for the possibility of criminal liability – including corporate liability and, where applicable under national law, corporate manslaughter – in cases of serious and deliberate breaches of occupational safety obligations resulting in fatalities, in order to ensure full accountability; |

Urges the Commission to adopt stricter rules on subcontracting, including safeguards for equal treatment of subcontracted workers, the introduction of dissuasive sanctions, and the possibility for Member States to uphold or introduce more protective national measures for workers; calls on the Commission, with the aim of strengthening transparency and accountability throughout the supply chain, to limit subcontracting to two levels, to require mandatory disclosure of subcontractors and the proportion of the contract intended for subcontracting, and to ensure that contractors bear full responsibility for their subcontractors; further calls for the establishment of joint and several liability between economic operators and subcontractors in the event of violations of labour laws or collective agreements; |

Calls on the Commission to assess and propose EU-level measures to ensure that public procurement does not reward the lowest bid at the expense of occupational health and safety, including by strengthening training for contracting authorities, promoting occupational safety and health training requirements for economic operators and, where relevant, subcontractors, enabling the exclusion of operators convicted of serious breaches, and ensuring effective controls and dissuasive sanctions during contract performance; |
