Justification
This amendment introduces a targeted and agronomically sound exception to GAEC 5. While the objective of erosion control remains fully valid, the current standard does not account for situations where temporary tillage – including winter black fallow – is essential for plant health and long-term soil function. In several Member States, farmers face increasing pressure from soil-borne diseases such as Stolbur and Syndrome Basses Richesses, particularly in arable crop rotations. In these cases, tillage practices such as late-season ploughing and maintaining bare soil over winter are well-established agronomic tools to break disease cycles. Preventing these measures altogether for the sake of formal erosion control undermines plant protection strategies, reduces yields, and may ultimately damage the resilience of farming systems. By allowing Member States to define limited, justified exceptions based on site-specific risk and agronomic need, this amendment ensures that erosion control objectives are preserved without imposing blanket restrictions. It strikes a better balance between environmental protection and practical crop management. Moreover, it provides legal clarity and flexibility for national administrations to adapt GAEC 5 to regional realities – without weakening the conditionality framework as a whole.

The requirements of GAEC 9 are already largely covered by Statutory Management Requirements (SMR) 3 and 4, which implement the Birds and Habitats Directives. In practice, the multiple derogation requests submitted by farmers in relation to GAEC 9 reflect the excessive administrative burden it creates without delivering added environmental value.

Justification
The elimination of the provision on social conditionality, as its implementation is difficult from a practical point of view and involves a significant administrative burden for payment aid. The effective application of social conditionality directly depends on the public activities responsible for the implementation of legislation in the field of labour and health and safety at work - competences that do not fall within the remit of the paying authorities.
