Recital 36

Amendment

(36) The Commission should report regularly to the European Parliament and to the Council on the effects of the scheme under this Regulation through the relevant institutional committees. By 1 January 2030, the Commission should report to the European Parliament and to the Council on the mid-term application of this Regulation and assess the need to review the scheme. The report is necessary to analyse the impact of the scheme on the development, trade and financial needs of beneficiaries as well as on bilateral trade and on the Union's tariff income, with particular attention to the sustainable development goals.

For products from sensitive sectors of the Union economy, in particular steel, chemicals, automotive, machinery and textiles, tariff preferences referred to in Article 7 shall be suspended, in respect of products of a GSP section originating in a standard GSP beneficiary country, when the average value of Union imports of such products over three consecutive years from that country exceeds 10 % of the total value of Union imports of the same products from all GSP beneficiary countries.

(b) it has ratified all the conventions listed in Annex VI (the 'relevant conventions') and the Commission has not identified, based on available information, in particular the most recent available conclusions of the monitoring bodies under those conventions, a serious failure to effectively implement any of those conventions;

(b) it demonstrates respect for fundamental human and labour rights as reflected in the core conventions of the International Labour Organization and the main United Nations human rights instruments, without being required to ratify and effectively implement all conventions listed in Annex VI, in particular those relating primarily to climate and environmental protection or governance;

3. In drawing their conclusions concerning effective implementation of the relevant conventions, the Commission and where appropriate the European External Action Service shall assess the conclusions and recommendations of the relevant monitoring bodies, as well as, without prejudice to other sources, information submitted by the European Parliament or the Council as well as third parties, including governments and international organisations, civil society, and social partners.

3. In drawing their conclusions concerning effective implementation of the relevant conventions, the Commission and, where appropriate, the European External Action Service shall assess the conclusions and recommendations of the relevant monitoring bodies, as well as, without prejudice to other sources, information submitted by the European Parliament or the Council and by governments or international organisations. Information submitted by private actors, including civil society organisations and social partners, may be taken into account where it is accurate and reliable but shall not create any special complaint, control or co-decision rights.

Article 15 – paragraph 1

Amendment

1. The special incentive arrangement for sustainable development and good governance shall be withdrawn temporarily, in respect of all or of certain products originating in a GSP+ beneficiary country, where that country does not respect its binding undertakings as referred to in Article 9, points (d), (e) and (f), or the GSP+ beneficiary country has formulated a reservation which is prohibited by any of the relevant conventions or which is incompatible with the object and purpose of that convention as established in Article 9, point (c).

1. The special incentive arrangement for sustainable development and good governance shall be withdrawn temporarily, in respect of all or of certain products originating in a GSP beneficiary country, where that country does not respect its binding undertakings as referred to in Article 9, points (d), (e) and (f), with regard to the core human and labour rights. Non-compliance with other conventions listed in Annex VI, in particular those relating primarily to climate and environmental protection or governance, shall not in itself constitute a sufficient ground for temporary withdrawal.
