| Micro and small enterprises. within the meaning of Commission Recommendation 2003/361/EC, which are established in a Member State shall be permanently exempt from the obligation to appoint an authorised representative for extended producer responsibility pursuant to Article 56(3) of Regulation (EU) 2023/1542 when making batteries available to end-users in another Member State by means of cross-border distance sales. The other obligations of producers relating to extended producer responsibility shall remain unaffected. |

| Micro and small enterprises, within the meaning of Commission Recommendation 2003/361/EC, which are established in a Member State hall be permanently exempt from the obligation to appoint an authorised representative for extended producer responsibility pursuant to Article 45(3) of Regulation (EU) 2025/40 when making packaging or packaged products available to end-users in another Member State by means of cross-border distance sales. The other obligations of producers relating to extended producer responsibility shall remain unaffected. |
