| The Commission shall monitor the situation at Union level with a view to monitoring the impact of the CBAM on the Union internal market. Where the Commission, taking into account the relevant evidence, considers that the inclusion of a good in Annex I causes severe harm to the Union internal market due to serious and unforeseen circumstances related to the impact on the prices of goods, it is empowered to adopt delegated acts in accordance with Article 28 to remove this good from Annex I until those serious and unforeseeable circumstances have passed.’; | The Commission shall monitor the situation at Union level with a view to monitoring the impact of the CBAM on the Union internal market. Justification
Der Berichterstatter schlägt vor, diese Schutzklausel zu streichen, mit der Begründung, dass sie „die Widerstandsfähigkeit und Vorhersehbarkeit der CBAM untergraben könnte“. Das Gegenteil ist der Fall: Ein Mechanismus, der über keinerlei Abfederungsmechanismus verfügt, ist derjenige, der politisch anfällig wird, da die einzige Abhilfe, die zur Verfügung steht, wenn er einem Sektor der Union akuten Schaden zufügt, darin besteht, die Verordnung erneut zu überarbeiten. Die Schutzklausel ist befristet, faktengestützt und unterliegt der üblichen Kontrolle delegierter Rechtsakte gemäß Artikel 28, einschließlich des Einspruchsrechts von Parlament und Rat. Dieser Änderungsantrag stellt sie wieder her und fügt die Verpflichtung hinzu, innerhalb einer festgelegten Frist auf einen begründeten Antrag eines Mitgliedstaats zu reagieren, was dem Anliegen des Berichterstatters Rechnung trägt, dass die Bestimmung von branchenspezifischen Interessen vereinnahmt werden könnte: Die Kommission muss in jedem Fall öffentlich ihre Gründe darlegen.

| 1. The Commission shall carry out continuous monitoring of the impacts of the CBAM on the internal market, the competitiveness of industry, investments, industrial production, exports, consumer prices and security of supply. | |
| 2. In response to a duly reasoned request by a Member State, the Commission shall examine whether the requirements of paragraph 3 have been met. It shall issue to the requesting Member State a decision, including a statement of reasons, no later than four weeks after receipt of the request. | |
| 3. If, taking into account the available evidence, the Commission considers that the inclusion of a good in Annex I would have significant negative effects on the internal market due to serious or unforeseen circumstances or would significantly jeopardise industrial competitiveness, investments, production, exportability or security of supply in one or more Member States, it shall adopt a delegated act pursuant to Article 28 with a view to removing this good from Annex I on a temporary basis. The removal shall remain in force until the relevant circumstances no longer apply.’ |

Justification
The safeguard clause must not be limited to price effects alone. A duly reasoned request by a Member State shall trigger a decision accompanied by a statement of reasons no later than four weeks after receipt of the request. The Commission must take action in the event of significant risks to industry or supply.

| In Article 30, the following paragraph is added: ‘8b. By 31 December 2028, the Commission shall present a report to the European Parliament and the Council on the impacts of extending the scope of this Regulation to cover downstream goods. The following shall be quantified in this report: (a) the compliance costs incurred by Union importers and manufacturers that use imported intermediate inputs, whereby a distinction should be made between certification costs and administrative costs, and whereby the costs incurred by small and medium-sized enterprises should be determined; (b) the impacts of the extension on prices for the relevant goods in the internal market and on production and employment in the Union sectors that use these goods; (c) the actual carbon costs incurred by the manufacturers of the relevant goods in the Union compared to those incurred by their competitors in the People’s Republic of China, the United States of America, India, Brazil, the Russian Federation and the Member States of the Gulf Cooperation Council; (d) in the absence of adjustments for exports, the vulnerability of Union manufacturers that export the relevant goods to third-country markets. If the report identifies significant additional costs, losses in relation to competitiveness, production or employment, disproportionate administrative burdens, in particular for small and medium-sized enterprises, or disadvantages for Union exporters, the Commission shall enclose with the report a legislative proposal with a view to suspending, restricting or reversing the extension of the scope of this Regulation to cover downstream goods. For all measures proposed in response to such findings, the macroeconomic impacts of the CBAM on Union industry and international competitiveness must be taken fully into consideration.’ |

„Die Überprüfung sollte Korrekturmaßnahmen ermöglichen, bevor der Wirtschaft der Union erheblicher und möglicherweise irreversibler Schaden entsteht. Es erscheint daher sinnvoll, nicht nur einen nachgewiesenen Nettoverlust bei Produktion oder Beschäftigung zu berücksichtigen, sondern auch erhebliche Wettbewerbsnachteile, Verwaltungsaufwand und zusätzliche Kosten. Mit der Änderung würde die ursprüngliche Absicht beibehalten, eine evidenzbasierte Überprüfung zu gewährleisten, und gleichzeitig eine frühzeitigere und verhältnismäßigere Reaktion ermöglichen, wenn negative wirtschaftliche Auswirkungen festgestellt werden.“

Where necessary, this proposal shall encompass measures to repeal this Regulation and Directive 2003/87/EC. |

Justification
A finding of significant economic damage must trigger consequences. The Commission must present specific legislative measures; it must be possible for these measures also to include repealing the CBAM and the EU ETS.
