	(ea) the following paragraph 12a is inserted :
	'Member States may provide for derogations from the application of this Regulation in respect of certain goods listed in Annex I to this Regulation which are released for free circulation in an outermost region of the European Union within the meaning of Article 349 of the Treaty on the Functioning of the European Union. Member States shall, where applicable, notify the Commission and the other Member States of their intention to adapt the rules for the application of the CBAM in one or more outermost regions falling within their jurisdiction, specifying the territories and products covered by the derogation. They shall also set out the reasons justifying the derogation, the intended date of application and the measures envisaged to protect local economies and avoid any adverse effects of the application of the CBAM on them. These measures shall ensure that the products covered by the derogation are intended for local use and processing in the outermost region concerned. The notification shall be made no later than three months before the intended date of application. The Member State shall submit a report to the Commission every three years assessing the impact that the application of the CBAM would have on the flows of exempted goods.

The Commission shall monitor the situation at Union level with a view to monitoring the impact of the CBAM on the Union internal market. Where the Commission, taking into account the relevant evidence, considers that the inclusion of a good in Annex I causes severe harm to the Union internal market due to serious and unforeseen circumstances related to the impact on the prices of goods, it is empowered to adopt delegated acts in accordance with Article 28 to remove this good from Annex I until those serious and unforeseeable circumstances have passed.;	1. The Commission shall continuously monitor the situation at Union level with a view to assessing the impact of the CBAM on the Union internal market. Where the Commission, taking into account the relevant evidence, considers that the inclusion of a good in Annex I causes severe harm to the Union internal market due to serious and unforeseen circumstances, including by disrupting supply chains or distorting price formation, and that less intrusive measures would not be appropriate, it shall adopt, informing the European Parliament and the Council thereof, an implementing act to initiate the procedure for a temporary exemption in accordance with the examination procedure referred to in Article 29(2) of this Regulation.
	2. When proposing the implementing act referred to in paragraph 1, the Commission shall lay down, those serious and unforeseen circumstances and their impact on the Union internal market, gathering and evaluating any necessary information, including relevant and objective evidence provided by third parties and using the following criteria:
	(a) a sustained price increase (without taking into account the CBAM financial liability), where the average import price expressed in constant prices of a good for which the EU has import dependency has increased by more than 50% compared to the average import price of the same CBAM good over the previous ten years; and
	(b) for a price increase to be sustained, it should be observed over a period of at least six months.

	(20a) in Article 30, the following paragraph is inserted:
	'In the event of unforeseeable and exceptional circumstances causing significant harm to the Union’s internal market as a result of serious and unforeseen disturbances relating to the prices of goods covered by this Regulation, in particular where the inclusion of a good in Annex I contributes to such disturbances, the Commission, after taking into account all relevant evidence and carrying out an objective assessment, shall, where appropriate, take the necessary measures, including, in particular, by submitting legislative proposals, as required, to redirect CBAM revenues from those goods to the sectors affected by the serious disruptions to the internal market. Such a reallocation shall apply for a limited period, until the exceptional circumstances have ceased to exist.'
