Ja. whereas the UN Commission on Human Rights, in its Resolution 12 (XXXVII) of 6 March 1981, deplored the continuance of the occupation of Western Sahara by Morocco and affirmed the right of the Sahrawi people to self-determination; whereas the exploitation of natural resources, including water resources, in occupied territories without the consent of the people concerned undermines the right to self-determination and may entrench situations of occupation and instability; whereas the Court of Justice of the European Union, in Joined Cases C-778/21 P and C-798/21 P1a and in Joined Cases C-779/21 P and C-799/21 P1b, held that the application of EU-Morocco economic agreements to Western Sahara and its adjacent waters requires the consent of the people of Western Sahara, in light of the right to self-determination and the principle of the relative effect of treaties;

S. whereas the EU is supportive of the joint Israeli-Palestinian water governance mechanisms, including the relaunch of existing frameworks such as the Joint Water Committee, with a view to promoting equitable water distribution, improved transparency and effective infrastructure development; whereas unequal access to shared water resources remains a structural driver of instability in the Middle East, particularly in the Jordan River Basin, where historical and ongoing imbalances in allocation and control for Palestinian communities deepen socio-economic disparities; whereas, under existing arrangements, the Israeli authorities exercise effective control over the majority of water resources in and flowing from the West Bank;

S. whereas, although the Oslo Accords recognised the Joint Water Committee as a water governance mechanism, World Bank assessments have shown that it has in practice impeded Palestinian water development through the entrenchment of asymmetrical control and the veto power exercised by Israel; whereas the EU should therefore refrain from promoting structurally unbalanced mechanisms that cannot ensure equitable Palestinian access to water and sanitation; whereas unequal access to shared water resources remains a structural driver of instability in the Middle East, particularly in the Jordan River Basin, where historical and ongoing imbalances in allocation and control for Palestinian communities deepen socio-economic disparities; whereas, under existing arrangements, the Israeli authorities exercise effective control over the majority of water resources in and flowing from the West Bank;

T. whereas as a result of the conflict between Israel and Hamas, there has been extensive destruction of water, sanitation and hygiene infrastructure in the Gaza Strip, including desalination plants, waste-water treatment facilities and distribution networks, leaving much of the population without reliable access to safe drinking water and exacerbating humanitarian needs; whereas the Office of the UN High Commissioner for Human Rights reported in July 2025 that 89 % of Gaza’s water and sanitation infrastructure had been damaged or destroyed, leaving 90 % of household water insecure; whereas a rapid and unimpeded delivery of materials, fuel and technical assistance is necessary for the repair and reconstruction of critical water infrastructure, including pipelines, desalination units and waste-water treatment plants;

(ka) recognise that the deliberate deprivation of water and the systematic destruction of water and sanitation infrastructure in Gaza constitute grave breaches of international humanitarian law and serious violations of human rights; recall that, pursuant to Article 2 of the EU-Israel Association Agreement1a, respect for human rights and democratic principles constitutes an essential element of the agreement; call for the immediate suspension of the EU-Israel Association agreement in light of Israel’s serious and persistent violations of international law;
