Proposal for a regulation
Article 2 – point 2 – point ba (new)
Regulation (EC) No 1223/2009
Article 15 –paragraph 2a (new)
| Text proposed by the Commission | Amendment |
|---|---|
| (ba) the following paragraph is inserted: 2a. The assessment of substances under this Article shall explicitly take into account the relevant routes of exposure. Substances classified as hazardous solely for routes of exposure not relevant to the intended use of the cosmetic product shall not be subject to automatic restriction or prohibition. |
Or. en
Justification
The absence of a clear route-of-exposure approach leads to disproportionate restrictions. This amendment introduces scientific consistency and corrects a key shortcoming identified in CA2.

Article 2 – paragraph 1 – point 2– point bb (new)
Regulation (EC) No 1223/2009
Article 2 – paragraph 2b (new)
| Text proposed by the Commission | Amendment |
|---|---|
| (bb) the following paragraph is inserted: 2b. The assessment of alternatives shall remain proportionate and shall not lead to de facto prohibition where safe use of the substance has been established. |
Or. en
Justification
The current text strengthens alternative requirements, which risks indirect bans. This amendment ensures that safe substances are not removed solely due to theoretical alternatives.
