(3 a) The extension of the application period of Regulation (EU) 2021/1232 should not result in the delegation of core law-enforcement responisbilities to private actors. Providers of electronic communication services should in no case be placed in the position of acting as de facto enforcers or monitors within a regulary framework. Investigation, prosecution and sanctioning of criminal activities must remain exclusive responsibility of the competent authorities.

(3 b) The application of this Regulation should not result in the weakening, circumventing or undermining of end-to-end encryption. End-to-end encryption constitutes a safeguard for the confidentiality and security of electronic communications. Measures taken under this Regulation should therefore not require the systematic decryption of communications, nor the introduction of technical vulnerabilities or backdoors.

(3 c) Systematic or generalised monitoring of communications content, in particular automated scanning of text messages, should not be permitted under this framework. Detection measures should therefore be restricted to technologies that operate in a content-oblivious manner, such as the comparison of digital fimngerprints ("hashing"), or that function locally on a user's device prior to encryption, without affecting the integrity of end-to-end encryption.

-1 In Regulation (EU) 2021/1232, the following Article is inserted:

Article 3a

Detection technologies deployed under this Regulation shall be limited to systems that operate in a content-oblivious manner such as the comparison of digital fingerprints ("hashing"), or function locally on the user's device. Such technologies shall not include systematic scanning or filtering of text-based communications.
