O. whereas 69.2 % of EU households were owner-occupiers in 202333 , reflecting the importance of property ownership as a driver of stability, intergenerational wealth and freedom of investment; whereas half of EU homeowners have no mortgage, and around one quarter are still at risk of poverty34 ; whereas property ownership provides additional financial stability for families and pensioners; whereas disrespect for property affects communities and small property owners, especially in cases of illegal occupation or prolonged misuse of the dwelling in the context of contractual relationships that lack effective enforcement; whereas private property is threatened by illegal occupation, known as squatting, and systematic non-payment of rent phenomena, which harms communities and particularly small property owners, forcing them to exit the market and to rightfully recover their property, thereby reducing the available supply and contributing to rising prices whereas illegally staying in a property undermines the EU Charter and constitutes a violation of the rule of law; whereas the EU, Member States and public authorities bear responsibility for addressing property owners’ rights, and providing particular support to small-scale owners, families in need and vulnerable households;
O. whereas according to Article 17 of the Charter of Fundamental Rights of the European Union, ‘everyone has the right to own, use, dispose of and bequeath his or her lawfully acquired possessions, ... no one may be deprived of his or her possessions, except in the public interest and in the cases and under the conditions provided for by law, subject to fair compensation being paid in good time for their loss, and ... the use of property may be regulated by law in so far as is necessary for the general interest’; whereas evictions disproportionately affect at-risk groups and families, including low-income households and minority groups, and are too often carried out without consideration for the fundamental rights and dignity of the people concerned; whereas housing is often the sphere where inequalities are most visible, revealing forms of aporophobia, that is, discrimination based on socio-economic status or poverty; whereas evictions have deep and lasting effects on individuals and families, undermining mental and physical health, disrupting access to education, employment and care services, and entrenching cycles of poverty and social exclusion; whereas the EU, Member States and public authorities bear responsibility for providing effective housing solutions for the rights and needs of vulnerable households in accordance with the Charter of Fundamental Rights of the European Union, including, inter alia, its provisions on the fundamental right to human dignity, the prohibition of degrading treatment, non-discrimination and private property;

Underlines that the severe housing crisis the EU is suffering is deepening and that it is exacerbated by a persistent lack of effective measures to address its root causes, notably the financialisation of the housing sector, speculation, the significant and growing investment gap in social and affordable housing, and the proliferation of short-term rentals for tourists (‘touristification’) as well as rising energy and utility costs, aggravated by an aging and energy-inefficient building stock; regrets that speculative investment and the financialisation of housing are enabled by a permissive regulatory framework allowing mainly institutional investors such as hedge funds, mutual funds and banks to inflate prices by bidding up the cost of real estate, prioritising profit over affordability and leading to a severe disconnect between local incomes and housing prices; opposes the revival of the securitisation market, as securitisation created the housing bubble that triggered the 2008 financial crisis, and accelerates housing financialisation by turning mortgage loans into tradable assets, thus worsening housing affordability;

Considers it crucial to ensure that the housing sector is predominantly centred on public, non-profit – with a particular focus on cooperative and community-led models – and limited-profit housing providers and is guided by legally binding conditionalities to ensure universal, long-term access to affordable, sustainable and decent housing in order to prevent housing from being managed as a financial asset or commodity, given that the right to adequate housing is an essential need and a fundamental human right, recognised in international human rights law as part of the right to an adequate standard of living; emphasises the paramount importance for a significant increase in and prioritization of public investment for social housing in order to have their considerable expansion; is strongly convinced that legally binding conditionalities to guarantee the permanent affordability, sustainability and public ownership of social housing must be set out;

Calls for the adoption of an enabling legally-binding regulatory framework at EU and national level to ensure that no household is obliged to spend more than 30 % of their monthly disposable income on housing costs, in terms of rents or mortgages, housing-related taxes, and water and energy bills, building on the UN-recognised international benchmark for housing affordability known as the ‘30 per cent rule’; stresses that for poor households, spending even 10 or 20 % of their monthly disposable income on housing costs can be highly challenging, thus making it even more crucial to prioritise tailor-made public support, including through social housing and public guarantor access schemes, to ensure access to sustainable and decent housing solutions at affordable prices;

Notes that the gravity and multi-faceted nature of homelessness requires specific policy and service interventions alongside broader housing policies; strongly believes that the EU institutions and Member States must decisively step up their efforts to eradicate homelessness by 2030 at the latest; recommends that all Member States develop national housing plans, coupled with national homelessness strategies, in consultation with local and regional authorities, civil society organisations, people with experience of homelessness and other stakeholders; underlines that homelessness strategies should cover prevention, emergency response, rehousing and ongoing support; calls on Member States to further develop ‘Housing First’, which ensures permanent housing in combination with personalised support to help people exit homelessness; calls on the Commission to support Member States in developing and implementing homelessness strategies, notably in the context of the European Platform on Combating Homelessness (EPOCH), which should have a dedicated budget and multi-annual work plan from 2027; asks the Commission to make homelessness a priority in the forthcoming anti-poverty strategy and to ensure strong synergies between the strategy, the new European Pillar of Social Rights action plan, the EPOCH and the European Affordable Housing Plan to deliver an effective enabling framework for progress towards ending homelessness;

Recalls the ongoing climate and environmental emergency; recalls that the EU biodiversity strategy for 2030 identifies land take as one of the major threats to biodiversity; stresses that in addressing the housing crisis, priority should be given to the re-purposing, renovation and efficient use of the vast amount of public and private vacant housing stock, to sharing best practice and to creating a favourable legal framework to this end; firmly believes that the construction of any new builds must be in line with the EU goal of ‘no net land take by 2050’, as set out in the EU soil strategy for 2030; underlines the paramount importance of legally binding targets and ambitious and consistent soil health plans to credibly reach this goal; emphasises that, in the light of the massive biodiversity loss that we are already experiencing, new building should in any case not take place in natural areas of concern to the EU that are protected by the Habitats Directive;

Highlights that solutions already exist to build new housing without new consumption of natural areas, while, at the same time, improving building quality and increasing housing supply and diversity; underlines that these solutions range from gentle, horizontal and vertical density housing, co-designed with local residents, to urban renewal, including the development of lightweight housing;
14. Believes that, in zones of housing stress, land already designated for residential housing development should be exclusively allocated to social and affordable housing in order to prevent speculative use and ensure structural long-term affordability; underlines that Member States should be encouraged to develop clear, time-bound and legally secure instruments to enable the temporary community use for community benefit functions of underused or neglected land and premises, including assets held by municipalities and private owners, where these are left vacant without credible plans for timely reactivation, for social and affordable housing formats, in particular modular solutions; highlights that various solutions already exist to build new housing without new consumption of natural areas, while, at the same time, improving building quality and increasing housing supply and diversity; underlines that these solutions range from gentle, horizontal and vertical density housing, co-designed with local residents, to urban renewal, including the development of lightweight housing;
