(a) The agricultural products concerned are delivered by a member of a producer organisation or cooperative to the producer organisation or cooperative of which they are a member provided that the statutes of that producer organisation or cooperative or the rules and decisions provided for in, or derived from, these statutes contain provisions having similar effects to the provisions set out in points (a), (b) and (c) of paragraph 4;

Member States may, at the request of an interbranch organisation recognised under Article 157(1) or, an organisation deemed largely representative of an agricultural sector, decide to exempt certain specific sectors from the requirement for a written contract, set out in paragraphs 1 and 2 of this Article. This exemption shall apply without prejudice to the provisions of paragraph 7 of this Article.

Justification

The use of optional terms (particularly the term 'fair') must be reliable both for consumers and for farmers who should be attributed a remunerative price for their produce and labour under such labels. It is therefore vital that the use of such terms is certified or controlled in some way. Without such a backup, farmers may again be subject to the same market pressures from other actors in the supply chain, to declare a price as 'remunerative' whereas in fact the price paid remains low and/or the benefits of the optional label do not accrue to the farmer as primary producer.

Justification

To ensure sufficient transparency in prices for members of dairy cooperatives, their statutes should contain provisions with similar 'effects' (as well as similar objectives) as the contractual provisions of paragraph 4 (concerning, for example, price transparency, volumes, payment procedures). This wording on 'effects' is already found in the CMO Regulation 1308/2013 in force today, and so poses no additional burden on conforming cooperatives.
