(3 a) It is important to stress the contradiction between, on the one hand, trade agreements with Mercosur and the United States, which boost imports into the EU of food and agricultural products and fuel unfair competition, and, on the other hand, the urgent need to strengthen food sovereignty and safeguard European farmers by guaranteeing fair prices and a fair distribution of added value in the supply chain. The European Parliament should therefore reject the trade agreements with Mercosur and the United States.

Justification

The amendment aims at extending the possibility of establishing country-of-origin labelling provisions to all sectors defined in Article 1 of Regulation (EU) No 1308/2013 (from cereals to milk products, from processed fruit and vegetables to meat, ...), providing consumers with meaningful information while fully protecting the work of EU farmers.

Justification

The current COMAGRI drafting lacks legal certainty and could result in a multitude of legal issues for cooperatives. Clarifications are therefore needed to guarantee that farmer-owned cooperatives, which already provide milk supply agreements and embed fair contractual terms in their statutes, may avail themselves of a derogation from rigid requirements of mandatory milk contracts as envisaged under Article 148 of Regulation (EU) No 1308/2013.

(c a) the delivery concerns milk or milk products for which the Member State considers, following consultation of relevant representatives of farmers or of interbranch organisations recognised in accordance with Article 163(1), that the objectives pursued by the provisions set out in paragraphs 1 and 4 have been achieved for the products concerned or that the obligation to have written contracts or written offers would not be appropriate or proportionate as regards these products for other justified reasons.

Justification

This wording reflects what was agreed in the Council and aims to provide Member States with greater flexibility to adapt the mandatory contractual obligations to their specific circumstances and to the particular needs of the milk sector. This would empower Member States, following consultation with recognised farmer representatives, to authorise derogations where justified. Ensuring flexibility in this respect is essential so that Member States with well-established and successful models are not undermined by the imposition of a “one-size-fits-all” approach.

(8 a) In Annex VIII, Part IIa is added:

"Part IIa

'Meat, meat products and meat preparations’

1. For the purposes of this part of this Annex, ‘meat’ means edible parts of the animals referred to in points 1.2 to 1.8 of Annex I to Regulation (EC) No 853/2004, including blood. The meat related terms and names that fall under Article 17 of Regulation (EU) No 1169/2011 and that are currently used for meat and meat cuts shall be reserved exclusively for the edible parts of the animals.

2. ‘Meat preparations’ means fresh meat, including meat that has been reduced to fragments, which has had foodstuffs, seasonings or additives added to it, or which has undergone processes that do not alter the internal muscle fibre structure of the meat enough for the characteristics of fresh meat to be eliminated.

3. ‘Meat products’ means processed products resulting from the processing of meat or from the further processing of such processed products, so that the cut surface shows that the product no longer has the characteristics of fresh meat.

Names that fall under Article 17 of Regulation (EU) No 1169/2011 that are currently used for preparations shall be reserved exclusively for products containing meat.

These names include, for example:

- Beef

- Veal

- Pork

- Poultry

- Chicken

- Turkey

- Duck

- Goose

- Lamb

- Mutton

- Ovine

- Goat

- Hamburger

- Egg yolk

- Egg white

4. The poultry products and cuts defined in Regulation (EU) No 543/2008 laying down detailed rules for the application of Council Regulation (EU) No 1234/2007 as regards the marketing standards for poultrymeat shall be reserved exclusively for the edible parts of animals and products containing poultrymeat.

5. Without prejudice to the application of the provisions in Regulation (EU) No 1169/2011, the above-mentioned names shall not be used for any product other than the products referred to, and shall exclude cell-cultured and insect derived products.’

Justification

Only the use of terms that are explicitly tied to animal terms should be prohibited, rather than format-based terms such as “burger” and “steak”. This will create clarity for both consumers and companies and will remove unintended consequences, like accidentally banning the term “tuna steak”, which is a non-meat application of the term. The amendment broadens the scope to also include insect-derived products and underlines the need to ensure clarity and protection of consumers, as per the FIF Regulation (Regulation (EU) No 1169/2011).
