Manufacturers shall ensure that at least the vehicle parts and components listed in Part C of Annex VII are available as spare parts and components for a minimum of 20 years after placing the last unit of their vehicle model on the market, with a reasonable and non-discriminatory price for repair and maintenance operators and end-users.

Justification
While European manufacturers traditionally commit to supplying parts for at least 10 years, some non-European manufacturers often neglect after-sales service. It is crucial to establish a legal minimum period for the supply of spare parts and components, complementing the requirement introduced in Regulation 2023/1542 on Batteries. The requirement should be aligned with the average vehicle lifespan, which ranges between 18 years in Western and 28 years in Eastern European countries (source: https://www.eea.europa.eu/en/circularity/sectoral-modules/product-lifespans/evolution-of-the-average-passenger-car-age-in-the-eu-between-2013-and-2022).

Justification
It should be mandatory for all vehicle producers to join a producer responsibility organisation to fulfil their extended producer responsibility. It is only through such requirement that it can be ensured that all manufacturers contribute a fee that is eco-modulated to promote durability, reparability, efficient resource use, etc. The recent Commission decision to sanction manufacturers and their EU association, who created a cartel to the detriment of recyclers and consumers, shows that producers have an incentive to hide and underfinance the costs of handling end-of-life vehicles. Not requiring them to join a collective producer responsibility organisation would enable manufacturers to continue circumventing the costs. Justification
The average age of vehicles exported from the EU to Africa is 18 years. Exported vehicles are very polluting, also considering that particle filters are often removed and sold due to their high value. Having a Euro 4/IV age limit for vehicle export will ensure that the most emitting vehicles are scrapped instead of damaging health and the atmosphere in non-EU countries. Many developing countries start setting limits to the age of the vehicles that they import. With a European age limit on vehicle exports, we will show that we are aware of the issue and we will provide our recycling industry with increased supplies of vehicles for recycling.

[60 months from the date of entry into force of this Regulation], the Commission shall conduct an assessment of the potential expansion of the extended producer responsibility to vehicles exported from the Union and the modalities of a transboundary extended producer responsibility fee mechanism, to ensure that end-of-life vehicle treatment operations in third countries are adequately financed. The assessment shall be followed, where appropriate, by a legislative proposal to the European Parliament and the Council.

Justification
If end-of-life vehicle management costs incurred in third countries are not covered by EPR, then EU producer responsibility organisations will delegate the management of the exported vehicles to third countries, while retaining the fees meant to pay it. This is particularly unfair for low- and medium-income countries that lack the infrastructure to handle the environmental hazards associated with managing such complex products. That is why the EU should develop a streamlined and transparent transboundary EPR fee mechanism.
