on the draft Council decision on the conclusion, on behalf of the European Union, of the Agreement between the European Union and the Federative Republic of Brazil on cooperation with and through the European Union Agency for Law Enforcement Cooperation (Europol) and the Federal Police of Brazil

– having regard to the draft Council decision (05617/2025),
– having regard to the draft Agreement between the European Union and the Federative Republic of Brazil on cooperation with and through the European Union Agency for Law Enforcement Cooperation (Europol) and the Federal Police of Brazil (05618/2025),
– having regard to the request for consent submitted by the Council in accordance with Article 16(2) and Article 88, and Article 218(6), second subparagraph, point (a)(v), and Article 218(7), of the Treaty on the Functioning of the European Union (C100045/2025),
– having regard to Rule 107(1) and (4), and Rule 117(7) of its Rules of Procedure,
– having regard to the recommendation of the Committee on Civil Liberties, Justice and Home Affairs (A10-0142/2025),
1. Gives its consent to the conclusion of the agreement;
2. Instructs its President to forward its position to the Council, the Commission and the governments and parliaments of the Member States and of the Federative Republic of Brazil.
EXPLANATORY STATEMENT
This agreement establishes cooperation between Europol and the competent authorities of Brazil with a view to allow the transfer of personal and non-personal data between them. Such an arrangement is necessary in order to support and strengthen the action by the authorities of the Member States of the Union and those of Brazil, in preventing and combating criminal offences, including serious crime and terrorism. At the same time, this agreement provides appropriate safeguards with respect to human rights and fundamental freedoms of individuals, including the right to privacy and data protection.
Law enforcement cooperation in the areas of counter-terrorism, prevention and combating of organised crime and corruption, drug trafficking, cybercrime, money laundering, terrorist financing, and, illegal migration, can bring extensive benefits to both parties and it is in the interest of the European Union. A growing demand for drugs and increased drug trafficking routes into the European Union is a serious threat to our security. Europol should therefore be able to cooperate closely, including through the exchange of personal data, with law enforcement authorities of third countries, such as Brazil, in order to fight all those dangerous crimes.
It should be also noted, that the European Data Protection Supervisor (EDPS) has confirmed, in its opinion that the agreement adduces adequate safeguards with respect to the protection of privacy and fundamental rights and freedoms of individuals.
The Rapporteur is of the opinion that the conclusion of this agreement will help in ensuring a safer and more secure Europe for our citizens. It is therefore recommended that the European Parliament give its consent to the conclusion of the agreement.
ANNEX: DECLARATION OF INPUT
The rapporteur declares under her exclusive responsibility that she did not include in her report input from interest representatives falling within the scope of the Interinstitutional Agreement on a mandatory transparency register, or from representatives of public authorities of third countries, including their diplomatic missions and embassies, to be listed in this Annex pursuant to Article 8 of Annex I to the Rules of Procedure.
