| 10. The thematic concentration requirements set out in paragraph 6 of this Article shall be complied with throughout the entire programming period, including when ERDF allocations are transferred between priorities of a programme or between programmes and at the mid-term review in accordance with Article 18 of Regulation (EU) 2021/1060. Where a Member State submits a request for an amendment of a programme in accordance with Article 24 of Regulation (EU) 2021/1060, amounts programmed for the specific objectives referred to in paragraph 1, points (a)(vi) and (b)(ix), of this Article, as well as for the specific objectives referred to in paragraph 1, points (a)(vii), (b)(v), (b)(xi), (b)(xii), (c)(iii), (d)(vii) and (e)(iii), of this Article, may be counted towards either the amounts required for PO 1 or PO 2 or divided between the two.. | 10. With this amendment we specify the contribution of the new specific objectives to PO1 and PO2, introducing the condition that the relevant projects actually contribute to climate mitigation and adaptation (with the exclusion of defense, dual use and military mobility)

Justification
Commission proposes to further broaden the scope of support from the ERDF, which until now allows funding to large enterprises in very specific and limited cases. This amendment thus deletes the new provision that would completely shift the focus of Cohesion Policy from SMEs to large enterprises

Justification
The text of the provisional agreement still allows for MS to reshuffle up to 8% within its cohesion policy financed programmes, regardless of the affected funding’s compliance with Article 15 of the Common Provisions Regulation. The compromise merely prevents ERDF/CF/JTF amounts for new priorities under the MTR from being transferred. The EP mandate, retabled here and amending the Common Provisions Regulation, is the only way to prevent Member States from reallocating commitments affected by a suspension of payments, thus circumventing in practice the need to address the reason for the suspension and ensuring free-riding on rule of law and compliance with the Charter of Fundamental Rights
