Article 54 – paragraph 2

2. The security of supply of defence products may be considered an imperative reason of overriding public interest within the meaning of Article 6(4) and Article 16(1)(c) of Directive 92/43/EEC and of overriding public interest within the meaning of Article 4(7) of Directive 2000/60. Therefore, the planning, construction and operation of related production facilities may be considered of overriding public interest, provided that the remaining other conditions set out in these provisions are fulfilled.	2. The security of supply of crisis-relevant defence products may not be considered an imperative reason of overriding public interest within the meaning of Article 6(4) and Article 16(1)(c) of Directive 92/43/EEC and of Article 4(7) of Directive 2000/60. Therefore, the planning, construction and operation of related production facilities may not be considered of overriding public interest;

	Article 54a
	Continuity of production of crisis-relevant defence products
	Where Directive 2003/88/EC applies to the relevant production activities, Member States may not decide to use or to encourage economic operators whose production site is located on their territory and which produce the crisis-relevant defence products concerned to make use of derogations provided for in Article 17(3) of Directive 2003/88/EC as this would allow for the expansion of working shifts and constitute serious risks for workers’ and occupational health and safety;
