Amendment

(1) The Union and individual Member States are facing shortages in a wide range of sectors and occupations, including in those relevant for the green and digital transitions. Extensive shortages in construction, healthcare, hospitality, transport, information and communications technology and in science technology, engineering and mathematics, are long-standing and have been exacerbated by the COVID-19 pandemic and the acceleration of the green and digital transitions. Labour shortages are expected to persist and potentially aggravate in the light of demographic challenges.

(1) The Union and Member States are facing temporary shortages in certain sectors. These shortages must be addressed as a matter of priority by activating the unemployed or underemployed national and European workforce, through retraining and by improving working conditions and wages. These measures must be complemented by an ambitious natalist policy in order to respond to the structural demographic challenge.

(21 a) Whereas the Comprehensive Framework of Cooperation on Mobility between the European Union and India, signed on 27 January 2026 in New Delhi in parallel with the negotiations on the free trade agreement, facilitates access to the European labour market for a significant number of qualified Indian professionals, particularly in the digital, information technology and services; whereas this agreement, when combined with the EU Talent Pool mechanism, could significantly increase the flow of non-European workers to Member States; whereas this development raises legitimate concerns about the potential impact on employment, wages and working conditions for European citizens, as well as on the balance of the national labour market in the sectors concerned; that, in this context, it is essential to fully preserve the principle of priority for EU workers and to ensure that any non-European recruitment remains strictly subsidiary, conditional on a proven and verified shortage at national level; that Member States must retain full sovereignty to decide on their effective participation in such mechanisms and to adapt their application to the realities of their labour market and their national priorities;

Only professions falling within groups 1 and 2 of the ISCO-08, namely managerial occupations and highly skilled intellectual and scientific occupations, are eligible for inclusion in the EU Talent Pool.
