Member States should therefore take all necessary measures, inter alia, to provide access to international protection and adequate reception conditions to those in need, to enable the effective application of the rules on determining the Member State responsible for examining an application for international protection, to return illegally staying third-country nationals, to prevent irregular migration and unauthorised movements between them, and to provide support to other Member States in the form of solidarity contributions, as their contribution to the comprehensive approach.
(3) This Regulation should contribute to that comprehensive approach by enabling unilateral as well as joint actions of the Member States in the field of asylum and migration management policies. Member States should therefore take all necessary measures, inter alia, to provide for internal security of its citizens by restricting conditions for reception of those seeking a better life in Europe, to return illegally staying third-country nationals quicker and at a higher rate, to prevent illegal migration and unauthorised movements between Member States, and to provide support to other Member States in the form of voluntary contributions.

(3) This Regulation should contribute to that comprehensive approach by setting out a common framework for the actions of the Union and of the Member States in the field of asylum and migration management policies, by elaborating on the principle of solidarity and fair sharing of responsibility in accordance with Article 80 of the Treaty on the Functioning of the European Union (TFEU). Member States should therefore take all necessary measures, inter alia, to provide access to international protection and adequate reception conditions to those in need, to enable the effective application of the rules on determining the Member State responsible for examining an application for international protection, to return illegally staying third-country nationals, to prevent irregular migration and unauthorised movements between them, and to provide support to other Member States in the form of solidarity contributions, as their contribution to the comprehensive approach.
(3) In the light of the disproportionate responsibility being put on first Member States of entry under Regulation (EU) 604/2013, it is necessary to design a new system in full respect of Article 78(1) TFEU based on a fair share of responsibility and solidarity between Member States for applications for international protection. This Regulation should contribute to that aim by setting out a common framework for the automatic distribution of applicants for international protection across the European Union, including after a Search and Rescue operation. Member States should take all necessary measures, inter alia, to provide access to international protection and adequate reception conditions to those in need, to enable the effective application of the rules on determining the Member State responsible for examining an application for international protection, and to share responsibility across the European Union for the processing of applications for international protection.

(18) Given the specific characteristics of disembarkations arising in the context of search and rescue operations conducted by Member States competent authorities persons disembarked should be distributed in a proportionate manner among the Member States. In order to implement the mechanism, it is necessary that Member States forbid private actors from interfering in the migratory processes by carrying out search and rescue operations which may act as a pull factor for migratory influxes. As recent investigations proved, there are well established links between criminal networks of smugglers and private organisations acting as facilitators of illegal migration in breach of existing national and EU law. Member States should foresee a set of criminal and administrative sanctions in case of violation of national law. Where, in violation of existing law, a third country national disembarks on the European territory following an illegal search and rescue operation carried out by private organisation, the Member State responsible for registering the application should be the one that provided a navigation permit to the disembarking vessel.

The EU Relocation Coordinator should endeavour to prioritise vulnerable persons, in particular unaccompanied minors in the relocation and transfers. The EU Relocation Coordinator should, in cooperation with the Commission and the Asylum Agency, also promote coherent working methods, for the verification of any meaningful links that the persons eligible for relocation might have with Member States of relocation.

(21) Any illegal migrants that are disembarked should be detained and processed as soon as possible for return to their homeland by the Member State that allowed the disembarkation to take place. Member States that allow disembarkation should be made aware of the fact that they themselves will have to take the burden for allowing illegal migrants to enter into the EU area and it is their responsibility to prevent that the illegal migrants move to other the Member States at their own will. Member States failing this will have to face responsibility to take back illegal migrants for processing and return to their homelands.

(22) The overall contribution of each Member State to the solidarity pool should be determined through indications by Member States of the measures by which they wish to contribute. Where Member States contributions are insufficient to provide for a sustainable solidarity response the Commission should be empowered to adopt an implementing act setting out the total number of third-country nationals to be covered by relocation and the share of this number for each Member State calculated according to a distribution key based on the population and the GDP of each Member State.
